1.עניינה של העתירה שבפניי, ככל שניתן לרדת אל חקרה ואל פשרה, בניסיון לערער או להשיג על פסק דינו של בית משפט זה מיום 19.5.2009 בבג"ץ 4193/09, בו נדחתה עתירתו של העותר על הסף מן הטעם, בין היתר, מאחר שלעותר עמד סעד חלופי של פנייה ל בית המשפט המחוזי על פי סדרי הדין הקבועים בחוק.
לטענת העותר, פסק הדין לא ניתן לגוף העתירה ומכאן עתירתו הנוכחית "לקבל התייחסות לגוף העתירה".
2.בית משפט זה אינו יושב כערכאת ערעור על עצמו ואשר על כן דין העתירה להידחות על הסף.
3.בשולי הדברים אציין כי ענייננו בעותר טרדן וסדרתי, אשר מסרב להפנים את עקרון "סופיות הדיון" והוא מגיש עתירות חדשות לבקרים בנושאים אשר במובהק אין מקומם בבג"ץ ואעמוד על חלק מההליכים שנגלו נגד עיני.
בשנת 2008, הגיש העותר עתירה בבג"ץ 1748/08 כנגד בית המשפט המחוזי בתל-אביב לביטול החלטות מסוימות שניתנו בתיק אזרחי שניהל כנגד חברת הביטוח כלל. העתירה נדחתה בפסק דין מיום 6.3.2008 מן הטעם שבג"ץ אינו יושב כערכאת ערעור על החלטות בתי המשפט הדיוניים וכי העתירה נגועה ב"שיהוי כבד". על פסק דין זה הגיש העותר בקשה לעיון חוזר שנדחתה אף היא.
כעבור חודשיים הגיש העותר עתירה בבג"ץ 5429/08 בגדרה טען כי פסק הדין בבג"ץ 1748/08 אינו נוגע כלל לסוגיה שהעלה בעתירה. העתירה נדחתה על הסף בפסק דין מיום 19.6.2008 מן הטעם כי הלכה למעשה ביקש העותר לערער על פסק הדין שניתן בבג"ץ 1748/08 הנ"ל.
בחלוף שנה, הגיש העותר עתירה בבג"ץ 3864/09 בגדרה ביקש להורות לאגף שוק ההון והביטוח במשרד האוצר לחקור חשד לפלילים כנגד חברת הביטוח כלל, באותו עניין מושא העתירות דלעיל. העתירה נדחתה בפסק דין מיום 18.8.2009, בין השאר, בשל שיהוי כבד בהגשתה והעותר חוייב בהוצאות בסך 5,000 ש"ח. העותר הגיש בקשה לביטול פסק דין שנדחתה, וכעבור שנה, שוב, הגיש העותר בקשה לעיון חוזר שאף היא נדחתה.
ביום 14.4.10, הגיש העותר עתירה נוספת בבג"ץ 2579/10 כנגד בית המשפט העליון בה ביקש כי פסק הדין בבג"ץ 5429/08 יבוטל ועניינו יועבר לדיון מחודש אצל מותב אחר, וכי פסק הדין בבג"ץ 3864/09 יבוטל ויוחזר לדיון מחודש למותב שדן בו על מנת שתינתן החלטה לגוף העתירה ולא בנושאים שאינם קשורים לנושא. העתירה נדחתה מן הטעם שאינה אלא ניסיון לערער על פסקי דין שניתנו בבג"ץ בכסות של הגשת עתירה אחרת.
4.הנה כי כן, גם בעתירה דכאן מנסה העותר להרהר ולערער שוב על עתירה קודמת שהגיש ואשר נדחתה על הסף (בג"ץ 4193/09).
אשר על כן, אני דוחה את העתירה על הסף ומחייב העותר בהוצאות לטובת אוצר המדינה בסך 7,500 (שבעת אלפים וחמש מאות) ש"ח.
