פסק-דין

ביום 1.6.2014 קיבלה ועדת השרים להפרטה החלטה בעניין כפר שלם. ברור מן ההחלטה כי על ועדת המשנה של מועצת מקרקעי ישראל ליתן החלטה בעניין כפר שלם (כפי שהוחלט על ידי המועצה עוד ביום 15.3.2010). המשיבים המיוצגים על ידי פרקליטות המדינה וכן המשיבים 6 ו-7 הסכימו כי אם יינתן פסק-דין לפינוי בהליך האזרחי שהעותרים הינם צד לו, הרי פסק הפינוי לא ימומש עד חלוף 30 ימים ממועד קבלתה של החלטה על ידי ועדת המשנה. משמע, אף אם יינתן פסק פינוי הוא לא ימומש באופן מיידי והדרך תהא פתוחה בפני העותרים לפנות לבית המשפט המוסמך לשם תקיפת ההחלטה שתקבל ועדת המשנה.

על רקע האמור דין העתירה להימחק וכך אנו מורים. לא ייעשה צו להוצאות.
