פסק-דין

1.הרכב מורחב של בית משפט זה קבע ביום 21.2.2012, בדעת רוב, כי חוק דחיית שירות לתלמידי ישיבות שתורתם אומנותם, התשס"ב-2002, הידוע כ"חוק טל", אינו מקיים את תנאי פסקת ההגבלה של חוק יסוד: כבוד האדם וחירותו, ולפיכך אינו חוקתי (בג"ץ 6298/07 רסלר נ' כנסת ישראל (21.2.2012) (להלן, בהתאמה – חוק דחיית השירות ו- פרשת רסלר)). בדעת רוב נקבע, כי החוק יעמוד על כנו עד למועד סיום תוקפו – 1.8.2012. העתירות שלפנינו הוגשו סמוך לאחר פקיעת תוקפו של חוק דחיית השירות, ועל רקע העובדה שהכנסת לא פעלה לחוקק הסדר חלופי. עניינן של העתירות בבג"ץ 5823/12 ובג"ץ 6704/12 הינו בשאלה אם יש לצוות על המשיבים לאכוף את חוק שירות בטחון [נוסח משולב], התשמ"ו-1986 (להלן – חוק שירות ביטחון) על תלמידי הישיבות. העתירה בבג"ץ 6101/12 לא התמקדה בעצם גיוסם של בני הישיבות, אלא במבחנים אשר מכוחם מחלק משרד החינוך כספי תמיכה למוסדות תורניים. העותרים בעתירה זו טענו, כי משאין עוד מקור חוקי המסמיך את שר הביטחון לדחות את מועד ההתייצבות של בני הישיבות, הרי ממילא אין לבצע כל העברה של תשלומי תמיכות עבור אותם תלמידים.

2.הדיון בשלוש העתירות עבר גלגולים שונים, אשר חלקם תוארו בהחלטתנו מיום 22.8.2013, ואין צורך לחזור על הדברים. יצוין, עם זאת, כי במהלך הדיון בעתירות ניתנו שני צווי ביניים. צו הביניים הראשון ניתן ביום 22.8.2013. הצו מנע, החל מיום הינתנו, הפחתה של תקופת שירות או כל תקופה רלוונטית אחרת לעניין גיוסם ושירותם של בני ישיבות. צו הביניים השני ניתן ביום 4.2.2014 (בדעת רוב). מכוחו של צו זה נאסר על המשיבים 4-1 בבג"ץ 6101/12 לבצע העברות כספים לצורך תמיכה במוסדות תורניים, ביחס לתלמידי מוסדות תורניים ילידי השנתונים 1994, 1995 וחציו הראשון של שנתון 1996, אשר קיבלו צו גיוס למועדים שונים החל מחודש אוגוסט 2013, ואשר לא התייצבו לגיוס בשל החלטות כלליות לדחות את מועד התייצבותם.

3.הדיון בעתירות נערך כאשר ברקע הדברים התנהל בכנסת מהלך לחקיקת הסדר חלופי, שיבוא תחת חוק דחיית השירות. ביום 19.3.2014 הודיעו המשיבים המיוצגים על ידי פרקליטות המדינה כי ביום 12.3.2014 התקבלו בכנסת, בקריאה שנייה ושלישית, שני חוקים המייתרים את המשך הדיון בעתירות (חוק שירות ביטחון (תיקון מס' 19), התשע"ד-2014, וחוק שירות לאומי – אזרחי, התשע"ד-2014 (להלן – החוקים החדשים)). לפיכך עתרו משיבים אלה למחיקת העתירות. ביום 19.3.2014 קבע הנשיא כי על העותרים להגיב לבקשה למחיקת העתירות. תגובות אלו אכן הוגשו. בגדר התגובות התייחסו העותרים השונים אף לשאלה האם יש מקום לבטל את שני צווי הביניים שניתנו בעתירות. העותרת בבג"ץ 5823/12 הודיעה כי לגישתה אין מקום למחוק את העתירה. זאת, על מנת שניתן יהיה להותיר את צו הביניים הראשון על כנו. העותרים בבג"ץ 6704/12 הודיעו כי הם מסכימים למחיקת העתירה. העותרים בבג"ץ 6101/12 התנגדו לבקשת הפרקליטות. יוער, כי חלק מהעותרים עתרו לפסיקת הוצאות ככל שהעתירות תימחקנה.

4.לאחר שעיינו בטענותיהם של בעלי הדין הגענו לכלל מסקנה כי בעקבות קבלתם של החוקים החדשים, הרי אין עוד מקום להותרתן של העתירות תלויות ועומדות, ודינן להימחק. אכן, מעת כניסתם של החוקים החדשים לתוקף נשתנה המצב המשפטי הקיים, המתייחס לסוגיית גיוסם של בחורי הישיבות שתורתם אומנותם. מובן, כי אין בכוונתנו להתייחס להסדר החדש שקבעה הכנסת. יוער, כי בפני בית משפט זה תלויות ועומדות עתירות חדשות המופנות נגד ההסדר החדש: בג"ץ 1877/14 ובג"ץ 1937/14. עוד אנו סבורים כי עם מחיקת העתירות אין עוד הצדקה להותרתם על כנם של צווי הביניים שניתנו בהליכים דנא. לבסוף, סבורים אנו כי יש לפסוק הוצאות לטובת העותרים בנסיבות העניין.

5.אשר על כן, אנו מורים בזאת על מחיקת העתירות שבכותרת. צווי הביניים מיום 22.8.2013 ומיום 4.2.2014 בטלים. המשיבים המיוצגים על ידי פרקליטות המדינה ישאו בשכר טרחה בסך 25,000 ש"ח בכל אחת מן העתירות (בסך הכל 75,000 ש"ח).
