השופטת א' פרוקצ'יה:

1.העותר, יליד 1977, נתון במעצר מינהלי, המוארך מעת לעת מאז חודש ספטמבר 2006. לאחרונה, הוצא צו מינהלי, המאריך את מעצרו עד ליום 25.8.08. הצו אושר בביקורת שיפוטית על ידי בית המשפט הצבאי ביום 26.2.08, ובהחלטת בית המשפט נאמר, בין היתר, כי מ דובר בפעיל ג'אפ הקשור לפעילות צבאית של ארגון זה באזור מגוריו, ולתשתית שבצעה פעילויות צבאיות מסוכנות. ההחלטה מוסיפה כי "מהחומר עולה שהמשיב נגיש לאמל"ח".

ערעור העותר על אותה החלטה נדחה על ידי בית המשפט הצבאי לערעורים.

2.העתירה שבפנינו מבקשת לבחון מדוע לא ישוחרר העותר ממעצרו המינהלי, במיוחד בהתחשב במשך הזמן הרב בו הוא נתון במעצר הנאמד בשנתיים ימים. כן נטען, כי לא נוספו ראיות ממשיות המצביעות על מסוכנות העותר מאז מעצרו, והתשתית הראייתית הקיימת היא זו שהיוותה יסוד למעצרו מלכתחילה. לאור חלוף הזמן והתיישנותו של החומר הבטחוני, ובהעדר כל פעילות מהכלא המסכנת את הבטחון, מתבקש שחרורו של העותר מהמעצר המינהלי. ב"כ העותר, עו"ד חדד, הסכימה כי נעיין בחומר החסוי.

3.המדינה בתשובתה הצביעה על חומרתו של החומר הבטחוני כנגד העותר, הכולל גם נתונים בדבר מעורבותו של העותר בפעילות צבאית. לטענתה, לאור אופי פעילותו של העותר, ובהינתן הנסיבות הבטחוניות הכלליות בשטח, המשך מעצרו בשלב זה הינו כורח המציאות. המדינה ציינה עוד כי נבחנה האפשרות להעביר את עניינו של העותר למסלול פלילי, אולם הדבר לא הסתייע בנסיבות הענין.

4.בהסכמת ב"כ העותר, עיינו בחומר החסוי הקיים כנגד העותר. באנו לכלל מסקנה כי פרטי החומר מצביעים על מסוכנותו של העותר ברמה גבוהה. המידע אכן מצביע על כך שהעותר הינו פעיל ג'יהאד איסלמי, הקשור לפעילות טרור צבאית, המסכנת באופן ממשי את בטחון האזור. לפיכך קיים יסוד למעצרו המינהלי. יש לציין, כי מידע בטחוני לגבי העותר הגיע לאחר מעצרו, והוא מתייחס לפעילותו קודם למעצרו.

גורמי הבטחון לא יכלו לנקוט עמדה בשלב זה לענין הצפי בדבר המשכו של המעצר לתקופות נוספות, עם זאת, הם ציינו את המובן מאליו, כי הנתון של משך הזמן בו מוחזק העותר במעצר עד כה, העומד עתה על שנתיים ימים, יובא בחשבון על ידם בין יתר השיקולים הרלבנטיים שיישקלו על ידם בבואם להעריך את נחיצות הארכתו הנוספת של צו המעצר המינהלי בעניינו של העותר.

על יסוד הדברים האמורים, העתירה נדחית.
