הנשיאה ד' ביניש:

העותר, קצין משטרה, פוטר על פי החלטת מפכ"ל המשטרה בתוקף סמכותו לפי הוראת סעיף 10(2) לפקודת המשטרה ובאישורו של השר לביטחון פנים.

החלטת הפיטורין מבוססת על ראיות מנהליות שנאספו בחקירת מח"ש שהתנהלה על פי מספר תלונות שהתבררו תוך היותו בחופשה כפויה. חקירת מח"ש טרם הסתיימה נוכח הצורך לחקור עד מרכזי נוסף שהיה קושי לאתרו, לפיכך לא הוחלט בשלב זה אם העותר יועמד לדין פלילי.

אף-על-פי-כן על יסוד החומר שנאסף עד כה והועבר לראש אמ"ש במשטרה התברר כי בתקופת שירותו של העותר כקצין משטרה הוא היה מעורב בפעילות עסקית פרטית בנוגע לסחר בכלי רכב, תוך ניצול מעמדו כאיש משטרה, וקיים קשרים עם סוחרי רכב ובעלי מגרשים למכירת רכב. עיסוקו כלל גם טיפול ברכב שהיה גנוב והעותר ידע על כך ולא דיווח לממונים עליו ולא תיעד את פעולותיו.

בא-כוח העותר עשה מאמץ ניכר לשכנענו כי לעותר יש הסבר טוב להתנהגות המיוחסת לו וכי פעולותיו האמורות בוצעו ללא ידיעה על הרקע העברייני של האנשים שבא עימם במגע. העתירה שלפנינו אינה המסגרת הנאותה לבירור מכלול הטענות העובדתיות. די אם נאמר שברמה של ראיות מנהליות היתה למפכ"ל תשתית ראייתית מספקת לקבוע כי העותר אינו מתאים לשמש כקצין במשטרת ישראל, גם אם לזכותו עומדת פעילות מבצעית משטרתית מוצלחת.

אשר על כן העתירה נדחית.
