עניינה של העתירה בבקשת העותרים להורות למשיב לנמק "מדוע לא יעניק לעותרת 1 מעמד של אזרחות ו/או תושבות ו/או להאריך אשרת שהותה בארץ בהתאם לחוקי האזרחות ו/או בהתאם לכל חוק אחר".

דין העתירה להידחות על הסף, מן הטעם שלעותרים עומד סעד חילופי של פנייה ל בית המשפט לענינים מינהליים המוסמך לדון בכגון דא נוכח סעיף 12 לתוספת הראשונה לחוק בתי משפט לענינים מינהליים, התש"ס-2000 (ראו, לדוגמה, בג"ץ 3649/08 לודמילה שמנובה נ' משרד הפנים, לא פורסם, 20.5.08).

אשר על כן העתירה נדחית על הסף והדיון שנקבע ליום 4.10.2010 יבוטל. העותרים יפנו תוך 30 יום בעתירה מתאימה ל בית המשפט לענינים מינהלים ואם יעשו כן, יימנע המשיב מלהרחיק את העותרת 1 מהארץ עד להחלטה בבקשה למתן צו ביניים, ככל שתוגש.
