השופטת מ' נאור:
1.לפנינו עתירה נגד פסק דינו של בית הדין הארצי לעבודה בו אומנם התקבל ערעורה של העותרת, אך נפסקו נגדה הוצאות בסך 5,000 ש"ח. העתירה מכוונת למעשה נגד פסיקת ההוצאות.
רקע
2.בית הדין האזורי לעבודה נתן נגד העותרת פסק דין בהיעדר הגנה. העותרת הגישה בקשה לביטול פסק הדין מן הטעם שכתב התביעה שהגישה נגדה המשיבה 2 אומנם הומצא לה, אך הוא לא הומצא לחשב המלווה שמונה לה כפי שדורש סעיף 142ג1 לפקודת העיריות ולכן, לא נעשתה המצאה כדין. בית הדין האזורי לעבודה דחה את הבקשה לביטול פסק דין ועל כך הגישה העותרת בקשת רשות ערעור לבית הדין הארצי לעבודה. בית הדין הארצי לעבודה נתן רשות ערעור וקיבל את הערעור. בית הדין קבע כי נוכח סעיף 142ג1 הקובע חובת המצאה לחשב המלווה מתבקשת המסקנה כי במקרה של אי המצאה לחשב ואף אם בוצעה המצאה לעירייה אין מדובר בהמצאה כדין. על כן, כך נקבע, יש לבטל את פסק הדין שניתן בהיעדר הגנה מחובת הצדק. יחד עם זאת הוסיף בית הדין הארצי כי העותרת גרמה לעיכוב רב בהליך ולבזבוז זמנם של המשיבה 2 ושל בית הדין האזורי לעבודה מאחר שלא הגישה את כתב הגנתה במועד. בנסיבות אלה, כך נקבע, מוצדק לפסוק הוצאות נגדה אף אם מתקבלת בקשתה לביטול פסק הדין. בסופו של דבר קבע בית הדין הארצי לעבודה כי התיק יוחזר לדיון בתובענה גופה לבית הדין האזורי לעבודה תוך שהעותרת תשלם למשיבה 2 (התובעת) הוצאות בסך 5,000 ש"ח.

3.העותרת טוענת כי מתעוררת שאלה משפטית והיא האם במקרה של ביטול פסק דין מחובת הצדק רשאי בית הדין לפסוק הוצאות לטובת הצד האחר. העותרת טוענת כי קיימת פסיקה של בית משפט מחוזי לפיה כאשר מדובר בביטול פסק דין מחמת הצדק אין לחייב בהוצאות ומאחר שבית הדין הארצי לעבודה נהג אחרת יש מקום להתערבות בית משפט זה והעמדת ההלכה על מכונה. לטענת העותרת המקרה שלפנינו עומד גם במבחנים שנקבעו להתערבותו של בית המשפט הגבוה לצדק מאחר שאין מדובר בעניין שבמומחיותו המיוחדת של בית הדין לעבודה ומאחר שנפלה בפסק הדין טעות מהותית. לטענת העותרת מאחר שנקבע כי בהיעדר המצאה לחשב המלווה אין מדובר בהמצאה כדין לא היה מקום כי בית הדין האזורי ייתן פסק דין בהיעדר הגנה. על כן אין מקום לחייב את העותרת על שגגה שנפלה מלפני בית הדין האזורי. העותרת טוענת כי גם שורת הצדק מחייבת את התערבותנו שהרי אין זה צודק כי ייפסקו הוצאות דווקא לטובת הצד שהפר את חובת ההמצאה הקבועה בסעיף 142ג1.
הכרעה
4.עיינתי בעתירה על נספחיה והגעתי לכלל מסקנה כי דין העתירה להדחות על הסף. העותרת טוענת למעשה כי בית הדין הארצי לא היה מוסמך להטיל עליה הוצאות כאשר הוא מקבל את בקשתה לביטול פסק דין מחובת הצדק. אין לקבל טענה זו. תקנה 113 לתקנות בית הדין לעבודה (סדרי דין), התשנ"ב-1991 קובעת מפורשות כי "בכפוף להוראות כל חיקוק, יהיה ענין ההוצאות בכל תובענה, ערעור או הליך אחר, מסור לשיקול דעתו של בית הדין או של הרשם". תקנה 124 לתקנות מוסיפה כי בית הדין רשאי גם "ליתן הוראות בדבר הוצאות או בענינים אחרים ככל שייראה לו צודק". לגבי פסיקת הוצאות יש לבית המשפט גם סמכות טבועה (ראו רע"א 615/11 סופר מדיק (מדיק לייט) נ' ANTON HUBNER CMBH &CO. KG, פסקה 6 (טרם פורסם, 27.3.2011); ולדחיית העתירה לגבי פרשה זו ראו בג"ץ 3344/11 Anton Hubner GmbH & Co. KG נ' בית המשפט העליון בשבתו כבית משפט לערעורים אזרחיים (טרם פורסם, 5.5.2011)). נראה אפוא שענייננו אינו בשאלה של סמכות אלא בשאלה של אופן הפעלת שיקול הדעת. במקרה הקונקרטי החליט בית הדין הארצי להטיל על העותרת הוצאות. עניין זה אינו מסוג העניינים שיצדיקו את התערבותנו שהרי כידוע בית משפט זה איננו יושב כערכאת ערעור על פסקי דין של בתי הדין לעבודה. גם כשמדובר בערעור אין ערכאת הערעור נוטה להתערב בשאלה של הוצאות, והדברים הם מקל וחומר כאשר עסקינן בעתירה לבית המשפט הגבוה לצדק (ראו בג"ץ 6412/08 בוקובזה נ' בית הדין הארצי לעבודה ירושלים, פסקה 10 (טרם פורסם, 20.7.2008)).
5.אכן, התערבותו של בית משפט זה בפסיקת בית הדין לעבודה שמורה לאותם מקרים חריגים בהם נפלה טעות משפטית מהותית בפסק הדין וכאשר הצדק מחייב את תיקונה. שיקול מנחה בבחינה האם מדובר בטעות משפטית מהותית נגזר מאופייה של הבעיה, מחשיבותה הציבורית הכללית וממשקלה המשפטי הסגולי (ראו: בג"ץ 7152/09 מזרחי נ' בית הדין האזורי לעבודה בתל אביב יפו (טרם פורסם, 18.7.2010); בג"ץ 1790/00 ניתוב ביצוע תעשייתי בע"מ נ' שפיר (לא פורסם, 5.11.2001)). החלטה להטיל הוצאות במקרה הפרטני של העותרת אינה עומדת בקריטריון זה וזאת אף אם שגה בית הדין – ואיננו קובעים כי כך אירע (ראו והשוו: בג"ץ 8053/05 ביתן נ' בית הדין הארצי לעבודה (לא פורסם, 12.2.2006); בג"ץ 4829/04 אהרון נ' בית הדין הארצי לעבודה (לא פורסם, 2.5.2005)).
6.העתירה נדחית על הסף. משלא נתבקשה תגובה לא ייעשה צו להוצאות.
