1.בעתירה זו מבקש העותר, אסיר המרצה את עונשו בבית הסוהר "אוהלי קידר", למנוע, כלשונו, "שיחרור אסירים (מחבלים) ביטחוניים בעיסקת חילופי השבויים הנרקמת עתה מול המשיבים". לדידו, החלטת ממשלה לשחרר מחבלים, היושבים בבתי הסוהר כחוק לאחר שנשפטו בבתי משפט בישראל בגין עבירות נגד המדינה ותושביה, תהיה החלטה המנוגדת לזכויות יסוד כגון זכות השוויון, תסתור את עקרון החוקיות, ותעמוד בניגוד ל"הגשמת הסדר הציבורי". בנוסף לכך, מוצא העותר טעם לפגם בעובדה שלא נבדקה "שאלת האסירים הפליליים הישראלים היושבים בבתי כלא בארץ", שאותם ניתן לשחרר ולשקם.

2.המשיבים סבורים כי דין העתירה להידחות על הסף, הן משום שהינה תיאורטית, והן משום שסוגיית שחרורם של אסירים פלסטיניים "נמצאת כולה במסגרת הליבה הקשה של התחום המדיני המובהק בו בית המשפט אינו נוהג להתערב". כן מוסיפים המשיבים, כי ככל שהדבר נוגע לשחרור אסירים ישראליים המרצים את מאסרם הפלילי, הרי שהדבר שונה בתכלית מסוגיית שחרורם של אסירים ביטחוניים במסגרת הסדר כזה או אחר, וכי אם מבוקשו של העותר להשתחרר מוקדם מן המועד שנגזר עליו, פתוחות בפניו הדרכים הקבועות לשם כך בחוק.

3.לכך משיב העותר, כי בית המשפט מוסמך להתערב בהחלטה של רשות מינהלית, שעה שזו ניתנת משיקולים זרים. לשיטתו,"תשלום" מחיר גבוה, המתבטא בשחרור מאות אסירים תמורת שלושה חיילים שבויים, מרמז על שיקולים זרים מעין אלה. כן טוען הוא, כי לא סביר לשחרר מחבלים, אשר מניסיון העבר ידענו כי בחלקם שבים הם לבצע פיגועים. העותר מבהיר בתגובתו למשיבים, כי אינו חפץ "לנצל" עסקה במסגרתה ישוחררו אסירים ביטחוניים, ולהשתחרר בעצמו ממאסרו. עם זאת, חוזר הוא על תהייתו מדוע לא ניתנת כבר מזה 40 שנה חנינה כללית לאסירים ישראליים, בזמן שנשקל שחרורם של "רוצחים שפלים-זדים".

4.דין העתירה להידחות על הסף.

בית משפט זה מבקר אמנם את החלטות המינהל באמות מידה של סמכות וסבירות, אך באין החלטה מינהלית, לא יידרש בית המשפט לעתירה (ראו, לאחרונה, דברי השופטת פרוקצ'יה בבג"ץ 1570/07 עמותת "אומץ" – אזרחים למען מינהל תקין וצדק חברתי נ' השר לבטחון פנים, ניתן ביום 25.2.07, פסקה 8, ודבריו של השופט מצא המצוטטים שם). הכלל לפיו בית המשפט הגבוה לצדק לא ידון בעתירות תיאורטיות הינו כלל מוכר וידוע (ראו, למשל, בג"ץ 3057/93 דיאמנט-כהן נ' שר החינוך והתרבות, פ"ד מז(3) 525, 527; בג"ץ 3945/04 ולריו נ' בית הדין הארצי לעבודה, ניתן ביום 21.3.05; בג"ץ 11228/05 התנועה למען איכות השלטון בישראל נ' ועדת הכספים של הכנסת, ניתן ביום 1.1.06).

מאחר שהחלטת ממשלה על שחרור אסירים, כזו או אחרת, לא התקבלה, די באמור עד כה כדי לדחות את העתירה. משום כך איני נדרש לפסקי דין של בית משפט זה שעסקו בסוגיות דומות (כמו בג"ץ 1539/05 משל"ט – מכון משפטי לחקר טרור וסיוע לנפגעיו נ' ראש הממשלה, ניתן ביום 17.2.05, ובג"ץ 5272/05 משל"ט – מכון משפטי לחקר טרור וסיוע לנפגעיו נ' ראש ממשלת ישראל, ניתן ביום 9.6.05).

העתירה נדחית.
