1.העותר שירת בצבא קבע במשך 17 שנה, בין השנים 1996-1979. בשנת 1997 חלה בסרטן הבלוטות. בעקבות זאת, הגיש בקשה לקצין התגמולים (להלן – המשיב), לפי חוק הנכים (תגמולים ושיקום) [נוסח משולב], תשי"ט-1959. ביום 30.12.01 קבע המשיב כי אין קשר בין תנאי שירותו של העותר לבין מחלתו. העותר ערער על החלטה זו. ועדת הערעורים קיבלה את הערעור וקבעה (ביום 7.9.05) כי תנאי שירותו בצבא של העותר גרמו למחלתו. כן פסקה הוועדה סך של 3,500 שקלים חדשים כהוצאות משפט לטובת העותר. לא הוגשה בקשה לעיכוב ביצועה של החלטת ועדת הערעורים. המשיב הגיש לוועדת הערעורים "בקשה לביטול החלטה", בטענה כי זו ניתנה במעמד צד אחד. במקביל הגיש גם ערעור לבית המשפט המחוזי. בעניין הבקשה לביטול ההחלטה, קבעה ועדת הערעורים (ביום 27.6.06), כי מן הראוי להמתין עד להכרעה בערעור בבית המשפט המחוזי. הוועדה קבעה גם כי "אין מקום כי היא תכריע בבקשה לביטול החלטה שלה, מה עוד שקשה לקבל את הטענה, בנסיבות שהיו בתיק זה, כי ההחלטה ניתנה'במעמד צד אחד'".

ביני לביני, פנה העותר למשיב (ביום 12.3.06), ושב ופנה (ביום 23.4.06), בבקשה כי המשיב יזמנו לוועדה רפואית לצורך קביעת נכותו, כמתחייב מהחלטתה של ועדת הערעורים. פניות אלו לא נענו. בישיבת קדם משפט שנערכה בבית המשפט המחוזי, ביום 4.7.06, חזר וביקש העותר כי המשיב יזמנו לוועדה רפואית. בהחלטתו מאותו יום ציין בית המשפט, כי "ראוי היה שהמדינה תקיים אחר פסק הדין [של ועדת הערעורים] כל עוד לא עוכב ביצועו". יוער, כי הדיון בערעור קבוע לחודש מרץ 2007. משחלפו הימים והמשיב נמנע מלזמן את העותר לוועדה רפואית, הגיש העותר את עתירתו, שבה ביקש כי המשיב יזמנו לבדיקה על ידי ועדה רפואית לצורך קביעת דרגת נכותו, וכסעד ביניים ביקש שהמשיב יזמנו לוועדה כדי להתחיל בהליכים לקביעת דרגת הנכות.

2.ביום 6.12.06 הודיע המשיב, בתגובה לעתירה, כי הימנעותו ממתן הוראה לביצוע החלטת ועדת הערעורים מקורה בטעות, וכי העותר יזומן בקרוב לוועדה רפואית לשם קביעת דרגת נכותו. המשיב הוסיף, כי יושב-ראש הוועדה הרפואית כבר פנה לבית החולים שמטפל בעותר לשם קבלת חומר רפואי, ולכשיתקבל החומר, יזומן העותר לוועדה הרפואית. לפיכך, ביקש המשיב בהודעתו למחוק את העתירה ללא צו להוצאות.

3.בתגובתו להודעה זו (מיום 14.12.06), ביקש העותר לקצוב למשיב מועד – יום 31.1.07 או מועד אחר שיקבע בית המשפט – שעד אליו יזומן העותר לוועדה רפואית. טענתו היא כי לאור התנהלות המשיב עד כה, קיים חשש שהמשיב מנסה "למשוך" את זימון העותר לוועדה הרפואית עד לאחר הדיון בערעור במחוזי. העותר מוסיף, כי לא סביר שחלה "טעות במשרדי המשיב", כטענת המשיב, לנוכח פניותיו החוזרות של העותר, שלא זכו לתשובה. כמו כן, מבקש העותר לחייב את המשיב בהוצאותיו.

4.דין העתירה להימחק. יש להניח כי המשיב יפעל בהתאם לאמור בתגובתו ויזמן בהקדם את העותר לוועדה רפואית, שתקבע את דרגת נכותו. בהתחשב בכך שהמשיב החל בהליכים לקראת זימון העותר לוועדה רפואית רק לאחר הגשת עתירה זו, ונוכח העובדה שפניות העותר בעניין, בטרם הגיש את העתירה, הושבו ריקם, יש לחייב את המשיב בהוצאותיו של העותר.

העתירה נמחקת. המשיב ישא בשכר טרחת עורך דין של העותר בסך של 5,000 שקלים חדשים.
