השופט י' עמית:
1.העותר, עורך דין המציג עצמו כבן לעדות המזרח - כמי שהוריו ז"ל עלו ארצה מאפגניסטן - הגיש עתירה זו בכותרת "עתירה דחופה" למתן צו על תנאי כנגד המשיבים, חברי הועדה למינוי שופטים, המורה להם ליתן טעם מדוע לא ידונו וימנו שופט ממוצא מזרחי ל בית המשפט העליון. במסגרת העתירה, ביקש העותר צו ביניים האוסר על המשיבים לדון בישיבה הקבועה ליום 20.11.2011:
"...בסבב המינויים הנוכחי דהיינו, כב' השופטים נועם סולברג, צבי זילברטל ודבורה ברלינר, לדחות את מועד הישיבה הנ"ל על מנת לקבל רשימת מועמדים נוספים וראויים להתמנות כשופטים ל בית המשפט העליון וזאת מקרב בני עדות המזרח ולדחות את הישיבה למועד נוסף על מנת לאפשר לדון גם במועמדותם של המועמדים הנוספים מקרב בני עדות המזרח וכפועל יוצא מכך למנות שופט נוסף רביעי ל בית המשפט העליון בסבב המינויים הנוכחי".
2.אומר בקצרה כי דין העתירה להידחות על הסף ולו מחמת השיהוי הניכר בהגשתה, וממילא אין מקום להיעתר לבקשה לצו ביניים. העתירה הובאה בפני היום, יום חמישי בשעות הצהריים, והדיון בוועדה למינוי שופטים קבוע ליום ראשון הקרוב. רשימת המועמדים ידועה מזה חודשים רבים, ואף למעלה מכך, וחזקה על העותר שידע, או יכול היה לדעת, את זהות המועמדים ל בית המשפט העליון ואם יש או אין ביניהם מי מעדות המזרח.
הנחתנו היא כי הוועדה תשקול את פניית העותר, הגם שזו נשלחה אליה רק בימים אלה, ותחליט כחוכמתה.
