בא-כוח העותרים מייצג את עיריית עזריה, העותרת כנגד חלק מתוואי הגדר המערבי בתחומה.
שמענו את טענות בא-כוח העותרים, עו"ד זחאלקה, את עמדת באי-כוח המדינה ואת בא-כוח המשיבים 3-7, תושבים אשר תוואי הגדר נקבע מתוך התחשבות בהם ובצורך שלהם לקיים גישה כבעלי תעודות זהות ישראליות לירושלים. עוד לפני זמן הגיעה המדינה להסדר עם התושבים הללו ובכך ויתרה על העדיפות שראתה לתוואי המקורי של הגדר, שנקבע על פי שיקוליה לאורך הקו המוניציפאלי של ירושלים; לפיכך העתיקה את הגדר מזרחה מירושלים. התוואי המסומן באדום - מזרחה מהקו המוניציפאלי של ירושלים - נקבע עוד בשנת 2005, ועיריית עזריה לא עתרה כנגד הקו המבוסס על צו זה; בכך נפל שיהוי משמעותי בעתירתה כנגד התוואי האמור ושיהוי זה כשלעצמו מקים עילה לדחיית העתירה.
יש לדחות גם את אותו ראש של העתירה המופנה כנגד העתקת חלק מהגדר האמורה מזרחה והקמת גדר חדשה באורך של 100 מטר, שכן הדבר נעשה בהסכמת הדיירים המתגוררים בצמידות לגדר זו, וזאת במקום חלק מתוואי הגדר המצוי כיום ממערב לתוואי החדש אשר הסרתו תקל על רוב התושבים במתחם הרלוונטי.
החלטה זו של הסטת קטע הגדר מזרחה, מבטאת שיקול דעת שמאזן בין האינטרס הביטחוני לבין האינטרס של רוב תושבי המתחם והוא עומד במבחני המידתיות.
