פסק-דין

1.המשיבה 1 היא תאגיד העוסק בין היתר בעיקור פסולת רפואית ומשמש גם תחנת מעבר של פסולת חומרים מסוכנים. שתי הפעילויות התבצעו בו זמנית בשטח מפעלה של המשיבה 1 בפתח תקווה. פעילותו של המפעל מחייבת קבלת היתר פעילות מן המשרד להגנת הסביבה. ב-21.9.2008 ארע פיצוץ במפעל; היתה שריפה והיו 12 נפגעים ובהם כבאים. שניים מהנפגעים נפטרו ונגרמו מפגעים סביבתיים. המדינה טוענת כי היו ליקויים בהתנהלות החברה ומנהליה. המשיבה 1 טוענת לעומתה כי הסיבה לאירוע היא מעשה חבלה זדוני. ביום 6.10.2008 ביטל המשרד להגנת הסביבה היתר הפעלה שניתן למפעל בכל הנוגע לעיסוק כתחנת מעבר לחומרים מסוכנים. ביום 2.11.2009 החליטה רשות הרישוי לבטל את רשיון העסק של המשיבה. על כך הגישה המשיבה 1 עתירה מינהלית, במסגרתה התבקש צו ביניים שיורה על הארכת רשיונות העסק ועל מתן היתר רעלים. התקיימו בעתירה הליכי ביניים רבים והיא קבועה עתה לדיון לגוף העניין ביום 23.2.2009. אין צורך לעמוד על פרטי ההליכים.

2.בקשת רשות הערעור של המדינה (המשרד להגנת הסביבה) המונחת לפני נסובה על החלטתו של כב' השופט רוזן מיום 19.1.2009. ביקשתי וקיבלתי את תגובת המשיבים והחלטתי לדון בבקשה כאילו ניתנה רשות ערעור והוגש ערעור על פי הרשות שניתנה. בהחלטה קודמת מיום 14.12.2008, עליה לא הוגשה בקשת רשות ערעור, ניתן צו זמני לבקשת העותרת (המשיבה 1 לפני) המורה למשיבים (בעתירה המינהלית) לקבוע תנאי בטיחות ודרישות מינימום לעותרת הצריכים להבטיח בריאות ובטיחות העובדים אצל העותרת ותושבי האזור.

3.לא אכחד כי בהחלטה זו מיום 14.12.2008 יש דרגה לא קטנה של עמימות. תנאי הבטיחות הקונקרטיים לא פורטו בהחלטה. ההחלטה גררה בקשה לבזיון בית המשפט מטעם העותרת – המשיבה 1. על החלטת הביניים האמורה לא הוגשה, כאמור, בקשת רשות ערעור.

4.המבקשת העלתה בעקבות ההחלטה מיום 14.12.2008 דרישה לפיה יופעל רק חלק אחד ממפעלה של העותרת. בהחלטה מיום 19.1.2009 שהיא נשוא הבקשה שלפני קבע כב' השופט רוזן כי דרישה זו אינה חוסה בצל החלטתו מיום 14.12.2008. בית המשפט ציין לעניין זה:

"בית המשפט שידון בעתירה המנהלית יכול ויורה כן [להפעיל רק חלק מן המפעל-מ"נ]. ברם, בהחלטה לצו זמני [היא ההחלטה מיום 14.12.2008- מ"נ] לא כיוונתי ולא סברתי שיש להורות כך. באם המשיבים סבורים שתנאי בטיחות אינם מאפשרים קיום שתי הפעילויות בכפיפה אחת ידרשו קיום תנאים שיאפשרו, לעת הזו, קיום שתי הפעילויות בכפיפה אחת, כמו למשל הקמת קיר לבנים שיפריד בין האיזורים בהם מבוצעות הפעילויות הנ"ל. (מדובר רק בדוגמא ובוודאי ובוודאי לא בדרישה בטיחותית שצריכה להידרש על ידי המומחים לדבר).

הדרישות שעל המשיבים לדרוש הינן דרישות בטיחות בלבד.

לא מ דובר בדרישה למניעה או הפגת ריח רע, כמו גם לא דרישות חשובות אחרות שיכול וייקבעו בפסק הדין שיינתן בסופו של יום בעתירה גופה.

באלה הדברים על המשיבים לקבוע תנאי בטיחות שיאפשרו פעילות עד מתן פסק דין בעתירה, דרישות שיהא בהן להבטיח בריאות ובטיחות העובדים במקום והציבור המתגורר באיזור.

הדרישות המעודכנות תוגשנה למבקשת תוך 3 ימים מהיום."

5.על החלטה זו מיום 19.1.2009 הגישה המדינה בקשת רשות ערעור זו ועמה בקשה לעיכוב ביצוע. המבקשת טוענת כי משמעות ההחלטה היא שעל המבקשת לקבוע דרישות שיאפשרו את פתיחתו מחדש של מפעלה של המשיבה 1 בתנאים שאין בהם כדי להבטיח את בריאות הציבור ובטיחותו. תנאים אלה מסוכנים, לדעת המבקשת, ועלולים להביא לפגיעה בנפש, כפי שכבר התרחש במפעל. עמדתה המקצועית של המבקשת היא כי לא ניתן לקיים בד בבד את שתי הפעילויות בהן עוסקת המשיבה באופן שיבטיח את בריאות העובדים והציבור. עוד טוענת המדינה כי ההחלטה נשוא הבקשה נעשתה בלי בירור של כל העובדות הצריכות לענין ובכלל זה הרקע לדרישותיה של המבקשת ולטענות שבעובדה שהעלתה המדינה.

6.המשיבים 2 ו-3 תומכים בעמדת המדינה. המשיבה 1 מצידה העלתה טענת סף לפיה המדינה לא ביקשה לערער על החלטות קודמות ובעיקר על ההחלטה מיום 14.12.2008 שהפכה חלוטה. המשיבה 1 העלתה טענות שונות לגוף השאלות המקצועיות השנויות במחלוקת. כן העלתה טענות קשות כלפי המדינה המנצלת לרעה, לטענתה, את ההליכים המשפטיים.

7.לא אכחד כי נראה לי כי שורש הבעיה נעוץ דווקא בהחלטות קודמות הלוקות בעמימות שעיקרן הוראה למדינה – "תמצאי פתרון בטיחותי זמני", זאת כאשר פתרון כזה לא בהכרח מצוי. אפשר – ואין צורך לקבוע מסמרות בדבר – שאילו הוגשה בקשת רשות ערעור נגד ההחלטות הקודמות, יתכן והיה מקום להורות, על אף טענות המשיבה, כי אין מקום כלל לסעד זמני, אלא יש לברר את העתירה לגופה בהקדם. ואולם, בקשת רשות ערעור כזו לא הוגשה. רק מההחלטה נשוא הבקשה מתברר כי בית המשפט לא סבר שפתרון של הפעלה חלקית של עיסקה של המשיבה 1 עשוי לענות על דרישות ההחלטה מיום 14.12.2008. החלטה זו מקנה למבקשת את האפשרות לבקש לערער על השאלה אם ניתן לקיים באופן בטיחותי את שתי הפעילויות בהן עוסקת המשיבה 1 (ראו והשוו פסק דיני ב- בר"ם 7724/08 הוועדה המקומית לתכנון ולבניה חולון נ' מנשה, פסקה 14 (טרם פורסם, 11.11.2008)). ואולם, התשתית העובדתית הצריכה להכרעה כזו טעונה, כפי שטענה המבקשת, ליבון ובירור.

8.אשר על כן, איני רואה מנוס מקיום דיון במעמד הצדדים בתוך 7 ימים בפני הערכאה הראשונה בו יישמעו טענותיהם וראיותיהם של הצדדים, ובית המשפט יברר אם אכן ניתן להפעיל באופן זמני את העסק כולו באופן שאין בו חשש לפגיעה בבטיחות. אף אם שגתה המבקשת בכך שלא ביקשה רשות ערעור על ההחלטה מיום 14.12.2008, אין הדבר מצדיק הטלת סיכונים בטיחותיים על העובדים במפעל ועל הציבור אם קיימים כאלה בשילוב של שתי הפעילויות. במאזן הנוחות, האינטרס בקיום בטיחות גובר על האינטרס של המשיבה 1. בית המשפט ישקול מחדש אם ניתן לקיים את שתי הפעילויות יחד, ויפעל כחוכמתו.

9.הערעור מתקבל במובן זה שלעת הזו מעוכבת ההחלטה נשוא הערעור. בית המשפט יוכל, אם ימצא לנכון, לתת צווים חדשים לאחר הדיון שיקבע, רק אם ישתכנע, לאחר שמיעת טענות, כי אין נשקפת סכנה לציבור או לעובדים מהמשך פעילותו של המפעל במתכונת זו או אחרת.

10.לא יהיה צו להוצאות בבקשה זו.
