פסק-דין

1.המבקש הגיש לבית המשפט המחוזי בתל אביב, ביום 28.12.06, בקשה לאישור תובענה ייצוגית נגד המשיבות, מכוח חוק תובענות ייצוגיות, התשס"ו-2006. ביסוד התביעה עומדת הטענה כי המשיבות לא צירפו כתוביות ותרגום לשפת הסימנים למשדריהן, בניגוד לחובתן על פי חוק שידורי טלוויזיה (כתוביות ושפת סימנים), התשס"ה-2005. בגדר הבקשה לאישור התובענה הייצוגית הגיש המבקש ביום 16.9.07 בקשה למתן צו גילוי ועיון במסמכים ספציפיים. בהחלטה מיום 21.11.07 דחה בית המשפט המחוזי (כבוד השופטת ע' ברון) את הבקשה, מן הטעם כי מדובר בבקשה כוללנית וגורפת שאינה הולמת בקשה לגילוי מסמכים ספציפיים. על החלטה זו הוגשה בקשת רשות הערעור שבפניי. בבקשה לרשות ערעור צמצם המבקש באופן משמעותי את היקף המסמכים שאת גילויים הוא מבקש. בהחלטתי מיום 20.1.08 הוריתי למשיבות להשיב אך ורק לעניין האפשרות כי תוגש לבית המשפט המחוזי בקשה חדשה לגילוי ועיון, אשר תצומצם בהתאם למבוקש בבקשה לרשות ערעור. המשיבות מתנגדות להצעה. לגישתן, אין לאפשר למבקש "מקצה שיפורים" לאחר שנדחתה בקשתו לגילוי ועיון במסמכים. עוד טוענות המשיבות כי גם היקף המסמכים שגילויים מתבקש עתה חורג מגבולות הראוי.

2.בדין דחה בית המשפט המחוזי את הבקשה לגילוי ועיון במסמכים שהגיש המבקש, באשר מדובר בבקשה שהיקפה חורג בהרבה מן הראוי לבקשה לגילוי מסמכים ספציפיים. זאת, במיוחד בשים לב לכך שמדובר בבקשה לגילוי ועיון המוגשת בגדרה של בקשה לאישור תובענה ייצוגית (ראו, רע"א 10052/02 יפעת נ' דלק מוטורס, פ"ד נד(4) 513, 519 (2003)). משאלו היו פני הדברים, רשאי היה בית משפט קמא לדחות את הבקשה כולה, ואיני רואה מקום לטרונייתו של המבקש על כך שבית המשפט לא בחן את כל אחד ואחד מפרטי הבקשה. עם זאת, בנסיבות העניין, ובהתחשב בשלב המוקדם יחסית בו נמצא ההליך, סבורני כי ראוי לאפשר למבקש להגיש את בקשתו המתוקנת בפני בית המשפט המחוזי. החלטתי על כן לדון בבקשה לרשות ערעור כאילו ניתנה הרשות והוגש ערעור על פיה. הערעור מתקבל, במובן זה שהמבקש רשאי להגיש תוך 20 ימים בקשה חדשה לגילוי ועיון לבית המשפט המחוזי. היקף המסמכים נשוא הבקשה החדשה יצומצם בהתאם למבוקש בבקשת רשות הערעור. מיותר לומר, כי איני מביע עמדה לגופה של השאלה האם יש לאשר את הבקשה החדשה. כלומר, אין להבין מהחלטה זו כי על בית המשפט המחוזי להיעתר לבקשה החדשה. לכל אחד מבעלי הדין שמורות מלוא טענותיו. המבקש יישא בשכר טירחת עורך דין בסך 5,000 ש"ח לזכות כל אחת מהמשיבות.
