דנו בבקשת רשות הערעור כבערעור והחלטנו לקבל את הבקשה. המשיב תבע סילוק ידו של המערער ממקרקעין וממחסן שהוא מחזיק בהם, כפי שהתברר רק בהליך שלפנינו, לפחות החל משנת 1967. לא הייתה מחלוקת בבית משפט השלום ובערכאת הערעור כי בחלקה צמודה בה החזיק המערער במבנה על פי חוזה עם עמידר הוא פונה וקיבל על כך פיצויים. המערער ביקש להתגונן בטענה כי מעמדו לעניין החזקת מחסן בשטח של 55 מטר המצוי במקום היה אף הוא כשל דייר מוגן; לטענתו לא אופשר לו לעיין במסמכים הרלוונטיים בתיקי המשיב, אך בית המשפט בערכאה קמא לא נתן לו רשות להתגונן בהליך ותביעת המשיב נתקבלה. ערעורו בבית המשפט המחוזי נדחה ובפנינו באה בקשת רשות ערעור.

בדיון שקיימנו ביום 13.10.2010 קבענו בהסכמת באת-כוח המשיב כי יאופשר למערער לעיין בתיקים ולמצוא את המסמכים עליהם הוא מסתמך בטענתו כי הוא מחזיק במחסן על פי חוזה שנחתם עימו. עתה עולה מעדכון שנמסר לנו ומסמכים שצורפו, כי יש לכאורה אחיזה לטענתו, בדבר דיירות מוגנת במסמך של עמידר משנת 1975.

עניינו של המערער מתגלגל בערכאות למעלה מעשר שנים, לא מנינו את כל ההליכים שהתקיימו בעניינו. נציין רק כי בסופו של יום, הדלתות בהליכים שנתקיימו נסגרו בפניו, ועד היום לא ניתנה לו רשות להתגונן. מבלי שננקוט בעמדה לגופה של המחלוקת, אין ספק שהייתה ראויה להתברר מלכתחילה וחבל על ריבוי ההתדיינויות שאיפיינו פרשה זו.

אנו מחליטים, אפוא, כי למערער תינתן רשות להתגונן והתביעה תתברר לגופה בבית משפט השלום בתל-אביב-יפו. טענות הצדדים שמורות להם והם יוכלו להגיש את כל המסמכים שברשותם.

הערעור מתקבל, כמפורט לעיל.
