פסק-דין

1.במהלך שיג ושיח הושגה בין בעלות הדין (המבקשת והמשיבות 1 ו-2) הסכמה כדלקמן:

א) באי כוח המשיבות 1 ו-2 יעבירו לידי באי-כוח המבקשת תוך 20 ימים העתקים מתשובותיהן של המשיבות 1 ו-2 לבקשה לאישור תובענה ייצוגית שהוגשה נגדן על ידי המשיב 3. באי כוח המשיבות 1 ו-2 רשאים יהיו להשחיר מן החומר את הקטעים הכוללים סודות מסחריים של שולחותיהם. ההכרעה אם מ דובר בסוד מסחרי (אשר ניתן להשחיר) תהיה נתונה לשיקול דעתם המלא של באי כוח המשיבות 1 ו-2.

ב) באי כוח המבקשת יוכלו לקבל בעתיד, על פי בקשתם, חומר נוסף שיוגש בהליך שהוגש נגד המשיבות 1 ו-2. גם לגבי חומר כאמור רשאים יהיו באי כוח המשיבות 1 ו-2 להשחיר קטעים הכוללים סודות מסחריים של שולחותיהם. ההכרעה אם מדובר בסוד מסחרי (אשר ניתן להשחיר) תהיה נתונה לשיקול דעתם המלא של באי כוח המשיבות 1 ו-2.

ג) כל החומר שיועבר, כאמור, יימסר לעיון באי כוח המבקשת בלבד, והללו לא יעבירו את החומר לשולחתם.

ד) מוסכם בזאת, כי כל ההתחייבויות המפורטות לעיל יחולו באופן הדדי, כלומר אף על המבקשת ופרקליטיה, בקשר עם ההליך הייצוגי שהוגש נגדה בת"צ 37347-03-13. תוך 20 ימים יועברו לידי פרקליטי המבקשת המסמכים מאותו סוג שעל המשיבות למוסרם לפי האמור בסעיף (א) לעיל. למען הסר ספק מובהר, כי אף האמור בסעיפים (ב) ו-(ג) לעיל יחול באופן הדדי.

ה) החלטתו של בית המשפט המחוזי מיום 30.9.2013 מבוטלת, לרבות החיוב בהוצאות שהושת על המבקשת. אם ההוצאות שולמו לידי מי מהמשיבות, יש להשיבן בצירוף הפרשי הצמדה וריבית מיום התשלום ועד למועד ההשבה.

2.ניתן בזאת תוקף של פסק-דין למוסכם. אין צו להוצאות. בכך מסתיים הטיפול בהליך שבכותרת.
