המשנה לנשיאה א' ריבלין:

הועדה הרפואית העליונה לפי חוק הנכים (תגמולים ושיקום), תשי"ט-1959 [נוסח משולב] קבעה למבקש נכות בגין מספר פגימות, ובהן הפגימה נשוא ענייננו, במיניסקוס הפנימי. המבקש סבר כי סיווג הפגימה היא שגוי, וכי לפיכך נקבעו לו אחוזי נכות נמוכים מדי (1% חלף 10%). לפיכך, הגיש ערעור לבית המשפט המחוזי. בית המשפט המחוזי דחה את הערעור, בקבעו כי טענותיו של המבקש נשקלו על-ידי הועדה, הוא נבדק באופן יסודי וגם המסמכים הרפואיים בעניינו נבחנו. מסקנתה של הועדה הרפואית – כך קבע בית המשפט קמא – היא בתחום המקצועי, ואין היא מעלה שאלה משפטית כנדרש לפי הוראת סעיף 12 א לחוק האמור.

המבקש הגיש בקשת רשות ערעור על ההחלטה. לדעתו, הועדה קבעה את נכותו לפי סעיף שאינו משקף כלל וכלל את מצבו הרפואי כפי שהיא עצמה קבעה אותו. לדעתו, נפלה בקביעת הועדה טעות משפטית המקימה עילה להתערבות. הבקשה הועברה לדיון בפני הרכב שלושה. בדיון נשאל המשיב אם נכון הוא להכיר במבקש כמי שנגרמה לו נכות של 10%. המשיב הודיענו כי אין באפשרותו להסכים לכך, שכן מ דובר לדידו בשאלה רפואית טהורה המצויה בסמכותה הבלעדית של הועדה הרפואית. עם זאת, המשיב מסכים לכך שהעניין יוחזר לוועדה הרפואית העליונה, "על-מנת שזו תשקול שוב אם יש מקום לקבוע את שיעור נכותו של המבקש לפי מבחן 48(2)(ז) I. אם הועדה תמצא לנכון שלא לקבוע לו שיעור נכות לפי מבחן זה, הועדה תנמק את החלטתה, בשים לב לקביעתה-שלה כי קיים נזק למיניסקוס הפנימי". המבקש הביע התנגדות להצעה זו אולם לאחר ששקלנו בדבר אנו סבורים כי בנסיבות העניין יש לקבלה.

לפיכך, החלטנו ליתן רשות ערעור ולדון בבקשה כאילו הוגש ערעור לפי הרשות שניתנה. פסק-דינו של בית-המשפט המחוזי יבוטל. התיק יוחזר כאמור לוועדה הרפואית העליונה, שתבחן מחדש את סיווג הפגימה של המבקש ותנמק החלטתה. החלטנו גם לבטל את ההוצאות (בסך 2,000 ש"ח) שהושתו על המבקש בבית המשפט המחוזי. אין צו להוצאות בערכאה זו.
