41. ביטול העיקול בשל העדר פעולה
תיקון: תשס״ט
עברו שלוש שנים מיום העיקול והזוכה לא הגיש בקשה למכירת המקרקעין המעוקלים ולא נעשתה בהם פעולה אחרת לפי סעיף 37, רשאי רשם ההוצאה לפועל, אף אם לא נתבקש לכך, לאחר שנתן לצדדים הזדמנות להשמיע טענותיהם, לבטל את העיקול, ומשעשה כן, יימחק רישום העיקול מפנקסי המקרקעין.
