83. נכס שנתמנה לו יותר מכונס נכסים אחד
תיקון: תשס״ט
(א)הוברר לכונס הנכסים כי לגבי הנכס שנתמנה לו, כבר נתמנה לפניו כונס נכסים אחר, שעדיין ממלא את תפקידו, יודיע על כך לרשם ההוצאה לפועל ויבקש הוראות.
(ב)רשם ההוצאה לפועל רשאי לבטל את צו מינוי כונס הנכסים שנתן או לתת כל הוראה אחרת, כפי שנסיבות הענין מחייבות, ולשם כך הוא רשאי לדרוש הגשת כל מסמך ולהזמין לפניו כל אדם הנוגע לענין, לרבות כונס הנכסים האחר או מי שלפי בקשתו נתמנה כונס הנכסים האחר.
