5. תחולה
(א)תקנות 2 ו־3 לא יחולו אם במועד הסירוב היה בחשבון שותף שאינו מגוייס ושאינו בן־זוגו של המגוייס.
(ב)תקנות 2 ו־3 יחולו גם על שיק שסורב שנמשך על חשבון של שותפות או של חברת מעטים כמשמעותה בסעיף 76 לפקודת מס הכנסה, אם השליטה בחברה או ב־50% לפחות מנכסי השותפות היא בידי מגוייס.
