108. תמלוגים בעד שימוש בפטנטים על־ידי המדינה
ניתן היתר לפי הסעיפים 104 או 105, ישלם אוצר המדינה לבעל האמצאה, לבעל הפטנט או לבעל רשיון יחודי, לפי הענין, תמלוגים שנקבעו בהסכם בין הצדדים, ובאין הסכם – על ידי הועדה לעניני פיצויים ותמלוגים.
