הנשיא א' גרוניס:

1.ערעור זה מופנה נגד החלטה שניתנה על ידי בית המשפט לענינים מינהליים בתל-אביב-יפו (כבוד השופט ד"ר ע' מודריק), בה נדחתה בקשת המערער לאישור תובענה ייצוגית נגד המשיבה. לפנינו בקשת הסתלקות מוסכמת, בה עותר המערער לאפשר לו לחזור מן הערעור. יצוין ברקע הדברים, כי לאחר שניתנה ההחלטה מושא הערעור, הגיש המערער בקשה שנייה לאישור תובענה ייצוגית נגד המשיבה (להלן – ההליך החדש). אף בקשה זו הוגשה לבית המשפט לענינים מינהליים והתנהלה לפני כבוד השופט מודריק. בהליך החדש גיבשו בעלי הדין הסדר פשרה (להלן – הסדר הפשרה). במהלך בחינת ההסדר, הוגשה לבית המשפט עמדת היועץ המשפטי לממשלה. היועץ לא הביע התנגדות לאישור ההסדר (פרט להסתייגות מסוימת שאין לה נגיעה להליך דנא), והותיר את ההכרעה לשיקול דעתו של בית המשפט. עם זאת, היועץ טען כי שכר הטרחה עליו הסכימו בעלי הדין הינו גבוה מדי. ביום 20.4.2014 החליט בית המשפט לענינים מינהליים לקבל את הסדר הפשרה וקבע את הסכומים של שכר הטרחה והגמול שישולמו לתובע המייצג ולבא כוחו. להסדר הפשרה ניתן תוקף של פסק דין ביום 26.4.2014.

2.בסעיף 8 להסדר הפשרה הסכימו בעלי הדין כי לאחר שיינתן תוקף של פסק דין להסדר (על ידי בית המשפט לענינים מינהליים), תוגש על ידי המערער בקשה למחיקת ההליך דנא. עוד נקבע שם, כי "החלטת בית המשפט העליון אודות מחיקת הערעור תיחשב תנאי מתלה בהסדר זה". מכאן הבקשה המוסכמת שלפנינו אשר נערכה במתכונת של "בקשת הסתלקות", כפי הנדרש בתקנה 11(ד) לתקנות תובענות ייצוגיות, התש"ע-2010 (השוו, ע"א 9585/11 יערי נ' מגדל חברה לביטוח בע"מ, פיסקה 3 (1.10.2013); ע"א 7809/12 חזאן נ' קלאב הוטל אינטרנשיונלס (א.ק.ה), פיסקה 7 (31.12.2013)).

3.אין מניעה לאשר את בקשת ההסתלקות, משזו הוגשה על רקע ההסכמה בהסדר הפשרה (אשר, כאמור, כבר קיבל את אישורו של בית המשפט לענינים מינהליים), ובהתחשב בזיקה ההדוקה בין שני ההליכים. עוד נזכיר, כי היועץ המשפטי לממשלה בחן את ההסדר לגופו ולא הביע התנגדות לאישורו. יצוין, כי בבקשת ההסתלקות לא נתבקשנו לפסוק שכר טרחה וגמול מעבר לסכומים שנפסקו על ידי בית המשפט לענינים מינהליים. כל שנתבקשנו הוא לאשר את ההסתלקות.

4.אשר על כן אנו מקבלים את בקשת ההסתלקות ומוחקים את הערעור. אין צו להוצאות בערעור. הבקשה להשבת האגרה תטופל על ידי אחד הרשמים של בית משפט זה.
