1.ערעור על החלטת בית המשפט המחוזי בתל אביב-יפו (כבוד השופטת א' כהן), מיום 28.4.2014, בת.א. 1715-07, לפיה נדחתה בקשת המערערים כי בית המשפט יפסול עצמו מלהמשיך לדון בהליך המתנהל בעניינם.

2.המערערים הגישו תביעה בשנת 2007, במסגרתה טענו לזכות חכירה של מקרקעין במושב רשפון. התביעה סולקה על הסף (על ידי כבוד הרשם ח' ברנר). בהמלצת בית משפט זה הסכימו בעלי הדין, בגדרו של ערעור, כי פסק דינו של בית משפט קמא יבוטל וכי יתקיים דיון לגופם של דברים, תוך שמירת מלוא טענות בעלי הדין לאחר שמיעת הראיות בתיק, לרבות הטענות בדבר מעשה בית דין, השתק ושיהוי (ע"א 5044/10, פסק דין מיום 18.6.2012). התיק חזר לבית המשפט המחוזי (כבוד השופטת א' כהן) ונשמעו בו ראיות. בעקבות דברים שאמר בית המשפט בתום ישיבת ההוכחות האחרונה מיום 19.3.2014, הגישו המערערים בקשה לפסילתו. טענתם הייתה כי דעתו של בית המשפט "נעולה" וכי הוא גמר בדעתו לדחות את תביעתם.

3.בית המשפט דחה את בקשת הפסלות בקובעו כי אין כלל עילת פסלות. בית המשפט הוסיף כי המערערים היו מיוצגים בהליך וכי הדיון התנהל כסדרו. בית המשפט ציין כי שמע את הראיות במלואן, תוך היעתרות לבקשת המערערים לזמן לעדות את כל העדים אשר ביקשו להזמין. בית המשפט הוסיף כי הציע למערערים לשקול את המשך ההליך והסב את תשומת ליבם לקשיים העומדים בפניהם להוכחת תביעתם (אך הוסיף, כי אינו זוכר אם חילופי הדברים נאמרו לפני מתן ההחלטה והוצאת הפרוטוקול לבעלי הדין או לאחר מכן). בית המשפט ציין עוד כי בקשת הפסלות הוגשה בשיהוי ניכר, שכן ישיבת ההוכחות האחרונה, בה נאמרו הדברים, התקיימה ביום 19.3.2014. עוד ציין בית המשפט כי המחלוקת בתיק היא משפטית בעיקרה ונסמכת על מסמכים ופסיקה, וכי הסב את תשומת לב בעלי הדין לפסיקה בנושא אשר ניתנה לאחר הגשת התביעה. לאור האמור קבע בית המשפט כי ההליך לא התנהל "בשום פנים ואופן בדרך של "משחק מכור"", ולכן דחה, כאמור, את הבקשה. מכאן הערעור שלפניי.

4.בית המשפט אף דחה ביום 13.5.2014 את בקשת המערערים לדחות את מועד הגשת הסיכומים מטעמם, שנקבע ליום 1.6.2014. בית המשפט קבע כי הגשת ערעור פסלות אינה מעכבת את המשך המשפט, אלא מנימוקים שיירשמו. בית המשפט ציין כי אין כל הצדקה להורות במקרה דנא על דחיית מועד הגשת הסיכומים עד להכרעה בערעור משום ששמיעת ההוכחות הסתיימה זה מכבר וכל שנותר הוא להגיש סיכומים וליתן פסק דין. בית המשפט הוסיף כי אם יתקבל ערעור הפסלות יועבר התיק לכתיבת פסק דין לשופט אחר, אשר יידרש לסיכומים שיוגשו, וכי אין כל חשש שאם יוגשו הסיכומים, הסעד שיינתן על ידי בית המשפט העליון יהיה מיותר, כטענת המערערים. בית המשפט קבע כי מועד הגשת הסיכומים, שכבר הוארך לבקשת המערערים, נקבע באופן שיאפשר כתיבת פסק דין בפגרה וכי אין הצדקה לדחייה נוספת. גם על החלטה זו משיגים המערערים והם מבקשים לעכב את הגשת הסיכומים עד להכרעה בערעור דנא.

5.המערערים, שאינם מיוצגים, טוענים כי בתום ישיבת ההוכחות מיום 19.3.2014, ובטרם הוגשו הסיכומים, פנה בית המשפט לבא-כוחם שייצגם אז ואמר לו, בין היתר, כי "העדים לא תומכים בגרסתכם, ברור לכם מה התוצאה, שיינתן פסק דין נגדכם, אולי תשקלו לבטל את ההליך". בעקבות דברים אלו ביקש המערער 1 לומר דברים ובית המשפט נעתר לבקשתו, אך דבריו לא נרשמו בפרוטוקול ולכן המערערים הגישו בקשה לתיקון הפרוטוקול. לאור חילופי הדברים ביקש בא-כוחם, כך לפי המערערים, להשתחרר מהייצוג, שכן סבר ש"המשחק מכור". בית המשפט נענה לבקשה. המערערים טוענים כי מדברי בית המשפט בדיון עלה כי דעתו ננעלה באשר לתוצאות התביעה, וכי החלטתו בבקשת הפסלות מאששת טענה זו. המערערים מציינים כי בית המשפט כלל לא הכחיש שאמר את הדברים שבבסיס בקשת הפסלות, אך טען שאינו זוכר מתי נאמרו. אשר לעניין השיהוי, טוען המערער 1 כי הוא אדם מבוגר וחולני, אשר הצליח ליצור קשר עם בא-כוחם רק לאחר חופשת הפסח, וכי רק לאחר השיחה עימו הבין כי עליו להגיש בקשת פסלות. המערערים מבקשים את התערבות בית משפט זה "על מנת שהצדק לא רק ייעשה אלא גם ייראה", להעביר את עניינם לשופט אחר שדעתו פתוחה לשכנוע.

6.המערערים ביקשו "להוסיף נימוק וראיה" לערעורם ובה טענו כי בית המשפט סירב לבקשתם לדחות את המועד להגשת סיכומיהם עד להשגת ייצוג משפטי. התנהלות זו של בית המשפט מוכיחה, לטענתם, כי דעתו של בית המשפט נעולה ליתן פסק דין נגדם, גם בדרך של חסימת ייצוג משפטי הולם.

7.כאמור, המערערים ביקשו לעכב את מועד הגשת הסיכומים עד להכרעה בערעור דנא. לטענתם, ההחלטה שלא לדחות את מועד הגשת הסיכומים היא המשך ישיר של התנהלות בית המשפט המעידה כי יתן פסק דין נגדם ואף ימנע מהם ייצוג הולם. לטענת המערערים, "הגשת הסיכומים מסיימת למעשה את התיק" כך שלא ניתן יהיה להעביר את התיק לשופט אחר. המערערים מבקשים אפוא, להורות על דחיית מועד הגשת הסיכומים עד להכרעה בערעור זה והעברת התיק לשופט אחר שיתכן שידחה את המועדים שנקבעו להגשת הסיכומים באופן שיאפשר להם להשיג ייצוג הולם.

8.דין הערעור להידחות. הלכה פסוקה היא כי, בדרך כלל, אין לראות בהתבטאויות בית המשפט בנסיבות דוגמת אלו שבמקרה דנא, משום חריצת דעה שאינה ניתנת לשינוי ולשכנוע, וכי יש לבחון כל מקרה על פי נסיבותיו. כבר כתבתי בעבר כי ניהול יעיל של הליכים משפטיים על ידי שופט מביא אותו, ולפעמים מחייב אותו, להביע דעה בזהירות ובמתינות לגבי ההליך התלוי בפניו. הדברים נכונים במיוחד כשהסוגיה התלויה בבית המשפט היא משפטית בעיקרה, כמו במקרה דנא, כפי קביעת בית המשפט קמא (השוו ע"א 513/14 ג' בארין נ' אגבארייה (23.2.2014)). כידוע, סמכותו הטבועה של בית המשפט היא לנהל את הדיון ולהציע הצעות, מתוך רצון לחסוך במשאבים של בעלי הדין ובזמנו של בית המשפט. יש לזכור כי בהליך בערכאה הדיונית נסתיימה שמיעת הראיות. במצב דברים זה רשאי בית המשפט להביע דעתו לגבי סיכויי ההליך, שהרי הכל פרוס בפניו, למעט סיכומי הצדדים. לכן, אין בעצם הדברים, ככל שנאמרו על ידי בית המשפט, כדי לבסס חשש ממשי למשוא פנים המקים עילת פסלות (השוו ע"א 1422/14 סרור נ' עיריית רמת גן (24.3.2014)), ומשכך, דין הערעור להידחות. לאור תוצאה זו ממילא מתייתר הדיון בבקשת המערערים לעכב את מועד הגשת סיכומיהם בבית המשפט קמא. על המערערים להגיש את הסיכומים על פי מה שהורה בית המשפט.

הערעור נדחה. משלא הוגשה תשובה אין צו להוצאות.
