ערעור על פסק דינו של בית המשפט המחוזי בתל אביב-יפו מיום 18.1.2011 בתיק עת"מ -1832/07 שניתן על ידי כבוד השופטת ש' גדות

פסק-דין
הערעור דנן הוגש על ידי המערערים בסוגיית אי תשלום ההוצאות בלבד. בסעיף 36 לפסק הדין קובע בית המשפט קמא בעניין ההוצאות כך: "לאור התוצאה אליה הגעתי, לא מצאתי צורך לדון בשאר טענות הצדדים, ולא מצאתי גם מקום לחייב בהוצאות". התוצאה שאליה הגיע בית המשפט בפסק דינו היא דחיית העתירות שבהן דן ומשכך, ככלל, נובע מאותה תוצאה חיוב בהוצאות של העותרות שעתירותיהן נדחו. התוצאה שאליה הגיע בית המשפט היא כשלעצמה אינה מצדיקה, אפוא, אי-חיוב בהוצאות. נימוק אחר, ככל שבגינו בחר בית המשפט שלא לחייב את העותרות בהוצאות, לא פורט בפסק הדין.
על כן, מוחזר הדיון לבית משפט קמא על מנת שינמק ויבהיר את החלטתו בסוגיית ההוצאות.
אין צו להוצאות בערעור.
