פסק-דין
הנשיא א' גרוניס:
1.בית המשפט לעניינים מינהליים בחיפה דחה עתירה של המערערת שמכוונת הייתה למנוע מתן רישיון עסק על ידי המשיבה 1 למשיבה 3. מכאן הערעור שבפנינו.
2.המשיבה 3 מפעילה עסק של מרכול בנכס הנמצא בבעלותה של המשיבה 2. הבניין בו מצוי הנכס נבנה לפני למעלה מעשרים שנה. הקבלן שהקים את הבניין בנה בו חלק מסויים, המשתרע על פני כ-150 מ"ר, שלא על פי היתר הבנייה. מאז הקמת הבניין משמש אותו חלק שנבנה שלא כדין כחלק ממרכול. המרכול שפעל במקום עד לכניסתה של המשיבה 3 למקום לפני כשנתיים היה בעל רישיון עסק. המערערת מפעילה אף היא מרכול, הממוקם במרחק של כ- 300 מטר מן המרכול של המשיבה 3. המערערת טוענת כי לא היה מקום ליתן רישיון עסק למשיבה 3 נוכח העובדה שהיא עושה שימוש אף באותו חלק של המבנה שנבנה שלא כדין.
3.אנו סבורים כי בנסיבות העניין צדק בית משפט קמא משדחה את העתירה. בדברנו על נסיבות העניין כוונתנו, בין היתר, לאלה:
א. המערערת עצמה הפעילה את עסקה במשך כשנה בלא רישיון עסק.
ב. במקום בו פועל כיום המרכול של המשיבה 3 פעל מרכול במשך תקופה ארוכה. המערערת לא פעלה נגד המחזיק שקדם למשיבה 3.
ג. כיום תלויה בפני הוועדה המחוזית לתכנון ולבנייה תכנית בניין עיר שמטרתה להכשיר את הבנייה החורגת הנ"ל. ביום 26.10.2011 החליטה הוועדה המחוזית להפקיד את התוכנית בתנאים. משמע, אם התוכנית תאושר לא תהא עוד בעיה מבחינת דיני התכנון והבנייה. כמובן, שאיננו מביעים כל עמדה באשר לתוכנית האמורה.
4.הנסיבות שצוינו לעיל הן המובילות אותנו למסקנה שדין הערעור להידחות. כמובן, שאם המשיבות 2 ו-3 לא ימשיכו לקדם את התוכנית או אם התוכנית לא תאושר תוך זמן סביר, תהא המערערת רשאית לנקוט הליך משפטי חדש בעניין.
הערעור נדחה. המערערת תישא בשכר טרחה בסך 20,000 ש"ח לטובת כל אחת משלוש המשיבות.
