פסק-דין

1.בפנינו 18 ערעורים על פסקי-דין בהם הוטלו הוצאות אישיות על המערער, עו"ד דניאל וגנר. פסקי-הדין ניתנו במסגרת עתירות מינהליות שהגיש המערער בשם לקוחותיו. הסכום המצטבר של ההוצאות שנפסקו מגיע לכ-180,000 ש"ח. העתירות בהן מ דובר, 18 במספר, הן כעשירית מתוך שטף של עתירות חסרות בסיס שהגיש העותר.

2.שמענו טיעונים קצרים. מתברר, כי המערער לא הגיש עתירות חדשות בעלות אופי דומה מאז הגשתן של העתירות חסרות הבסיס. בדבריו בפנינו התחייב העותר שלא לחזור ולהגיש עתירות בעלות אופי דומה.

3.נראה כי השופטים שדנו בעתירות נשוא הערעורים צדקו בהטלת הוצאות אישיות על המערער. עם זאת, נוכח התחייבותו של המערער ולאחר שהסתבר כי הוא הפסיק להגיש עתירות חסרות שחר בעלות אופי דומה, זכאי הוא להתחשבות מסוימת. כמובן, הנחתנו היא שהמערער לא יפר את התחייבותו. אם הוא יפר אותה, אין ספק שבתי המשפט יחייבו אותו שוב בהוצאות אישיות ובסכומים משמעותיים.

4.הערעורים מתקבלים באופן חלקי, כך שסכום ההוצאות הכולל ב-18 הערעורים שבפנינו יועמד על 45,000 ש"ח, נכון להיום. לא ייפסקו הוצאות בערעורים.
