פסק-דין

שמענו את טיעוני הצדדים, והערנו את הערותינו באשר לדחיפות העניינית הכרוכה בביצוע קיר-התמך למצוק באזור אפולוניה העלול לסכן חיי אדם במצבו הנוכחי.

ב"כ המדינה הודיעה כי הוקם צוות אשר בחן את כלל ההיבטים הכרוכים במדיניות התכנונית הנוגעת למצוק במלוא היקפו, המשתרע על למעלה מ- 40 ק"מ, ואשר התייחס, בין היתר, גם לקטע המצוק באפולוניה, הרלבנטי לענייננו. מסקנות הצוות מצויות עתה בבדיקת הגורמים הנוגעים בדבר, ויש להניח ולקוות כי במועד קרוב תגובש תכנית כוללת בענין זה, אשר תעמוד באמות המידה של דיני התכנון.

עוד יצויין, כי העבודות לבצוע קיר התמך במצוק אפולוניה נמצאות בעיצומן, ועתידות להסתיים בסוף חודש דצמבר השנה. קיר התמך הינו בבחינת פתרון זמני, אשר יש להניח כי ישתלב בהמשך הזמן בתכנית הכוללת, לכשזו תתקבל.

על רקע הדחיפות המיוחדת בבצוע קיר התמך במצוק אפולוניה להגנה על חיי אדם, ונוכח המהלכים לגיבוש מדיניות התכנון הכוללת המתנהלים עתה, ולאור זמניות הפתרון באזור נשוא ענייננו, הסכימה המערערת לחזור בה מערעורה.

בהקשר זה אנו מבהירות, כי לא בחנו את הקביעות המשפטיות שנקבעו בפסק הדין קמא, וממילא לא הכרענו בהן. לפיכך, השאלות שהן מעלות נותרות, לפי שעה, פתוחות.

בשים לב לכל אלה, הערעור נמחק בהסכמת המערערת.

הערעור נמחק, אפוא, בכפוף לאמור לעיל.
