הצדדים הסמיכו את בית המשפט לפסוק בערעור על דרך הפשרה לפי סעיף 79א לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984.

לאחר ששמעתי את טיעוני הצדדים, אני מחייב את המשיב (שלמה נרקיס) לשלם למערער הסך של 34,800 ₪.

הפיקדון יוחזר למערער.
