1.בעתירה שבפנינו נתבקש בית המשפט להורות למשיבים 1-2 (להלן: המשיבים) להימנע מלדרוש מהעותר את ניכויי המס החלים על המשיבה מס' 3 (להלן: המשיבה) בגין שנות המס 1998 - 2005 בהן עבד העותר כשכיר אצל המשיבה. לטענת העותר, בינו לבין המשיבה-מעסיקתו היה הסכם כי משכורתו בגין עבודתו כשליח לבנקים, תשולם על בסיס של משכורת נטו. לאחרונה, הוצאה לעותר שומה לפי מיטב השפיטה בגין השנים הנ"ל בהן עבד כשכיר אצל המשיבה. זאת, למרות שעל פי סעיף 164 לפקודת מס הכנסה [נוסח חדש] חובת ניכוי מס במקור חלה על המעסיק. לטענת העותר, ככל שהמשיבה לא שילמה את המס המתחייב מהעסקתו, על המשיבים לנקוט הליכים כנגדה, והוצאת השומה על שמו, כמוה כדרישת תשלום שנשלחה לאדם X בגין הכנסתו של אדם Y שאין כל קשר ביניהם. לטענת העותר, מתעורר חשש כי המשיבים פועלים משיקולים זרים ובלתי ענייניים ומסיבות השמורות עמם הם מעניקים למשיבה יחס מועדף "בשל היותה גוף רב השפעה 'מקושר' לגורמים פוליטיים, אנשי ציבור ואמצעי תקשורת".
2.דין העתירה להידחות על הסף. ככלל, אין בית משפט זה דן בעתירה כל עוד לא מיצה העותר סעד חלופי שעומד לו על פי דין (ראו בג"ץ 7190/05 לובל נ' מדינת ישראל (לא פורסם, 18.1.2006) פסקאות 11-12). במקרה דנן, לעותר סעד חלופי במסלול של השגה – ערר – ערעור במסגרת פקודת מס הכנסה. אם וככל שלא יעלה בידי העורר להצליח בהליכי ההשגה והערר, אין מניעה כי העורר יעלה את טענותיו בדבר שיקולים זרים של המשיבים במסגרת הליכי ערעור שיינקטו על ידו.
3.אשר על כן אנו דוחים את העתירה על הסף. מאחר שלא נתבקשה תגובת המשיב, אין צו להוצאות.
