פסק דין
בהמלצת בית המשפט ישלמו המערערים למשיב 11 (עיאס) באמצעות עו"ד רביב סך של 29,000 ש"ח. מתוך סכום זה ישולם מתוך הערבות הבנקאית שהופקדה סך של 25,000 ש"ח והיתרה תשולם תוך שלושים יום לאחר מכן. בכפוף לכך יתקבל הערעור במובן זה שתימחק הערת האזהרה הרשומה לזכות המשיב 11 בחלקות 45 ו-48 בגוש 10344 וניתן בזה פסק דין המצהיר כי המערערים זכאים להירשם – בכפוף להוראות כל דין – כבעלים של 30/168 חלקים בחלקה 45 ו- 6/16 חלקים בחלקה 48 בגוש הנ"ל, ו- 30/168 חלקים בחלקה 9 בגוש 10345.
