פסק-דין
1.בעלי הדין הסכימו כי נכריע על פי סעיף 79א(א) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984, בערעור זה. על פי המוסכם, עלינו לקבוע מהו חלקו של המשיב (וביתר דיוק חלקו של הנאמן בפשיטת רגל של המשיב) בבית המגורים שבמבשרת ציון. עוד הוסכם, כי ההכרעה תהא במנעד שבין 25% לבין 42.5% מתוך הבית כולו.
2.שקלנו את הטיעונים שהוצגו בפנינו, אלה שבכתב ואלה שבעל-פה. הגענו לכלל דעה כי חלקו של המשיב בבית המגורים יועמד על 37.5%.
3.נוסיף כי הושגה הסכמה אף בשני עניינים נוספים:
א. ההכרעה לעניין החלק בבית המגורים, שנקבע כאמור ל-37.5%, תחול אף לגבי הפירות, היינו לגבי כספים המתקבלים בגין השכרה או שימוש של חלקים בבית המגורים.
ב. חלקו של החייב בבית המגורים כפי שנקבע לעיל, לא ימומש כל עוד לא תינתן הכרעה חלוטה בשני הערעורים שהוגשו על החלטות הנאמן בתביעות החוב.
ניתן בזה תוקף של פסק-דין להסכמות האמורות.
4.עם מתן פסק-דין זה מסתיים הליך הערעור. לא ייעשה צו להוצאות.
