פטור מהתייצבות
פסק-דין
1.בית המשפט המחוזי בנצרת (כבוד השופטת נ' מוניץ) דחה תובענה שהגיש המערער בשל התיישנות. בתובענה נטען כי חתימה של המנוחה זריפה סלים ז"ל על יפוי כוח נוטריוני משנת 1947 הינה מזויפת. בתובענה אף נטען כי נפל פגם ברצון של המנוחה לעניין החתימה על יפוי הכוח. הערעור מופנה נגד פסק-הדין שדחה את התובענה.
2.סבורים אנו שדין הערעור להידחות. כאמור, בתובענה שהוגשה בשנת 2009 הועלתה טענת זיוף לגבי חתימה על יפוי כוח משנת 1947. המנוחה נפטרה בשנות התשעים של המאה שעברה לפני הגשת התובענה. בנסיבות העניין דעתנו היא שבדין נתקבלה טענת ההתיישנות. נוסיף כי אין זה ברור כיצד זה ניתן לטעון כי חתימה של המנוחה זויפה ובה בעת לטעון כי נפל פגם ברצון של המנוחה. ברור, כי טענה בדבר פגם ברצון מניחה, מניה וביה, שאומנם המנוחה חתמה על המסמך.
3.הערעור נדחה. המערער יישא בשכר טרחה בסכום של 25,000 ש"ח לזכות כל אחת משתי קבוצות המשיבים שהתייצבו לדיון בערעור והיו מיוצגות בו.
