1.לבקשת בעלי הדין ובלא לדון בערעור לגופו, ניתן בזאת תוקף של פסק-דין להסכם הפשרה שהוגש ביום 2.4.2014, והמצורף ומסומן כנספח "א" לפסק-דין זה.
2.בהתאם למוסכם, הערעור מתקבל, החלטת בית המשפט המחוזי בבאר-שבע מיום 28.4.2013 מבוטלת והתיק מוחזר לבית משפט קמא להמשך דיון בעניינם של המערערים – והכל כמפורט וכמוסכם בהסכם הפשרה.
