1.המערערות הגישו לבית משפט זה ביום 20.11.2013 ערעור על פסק דינו של בית המשפט המחוזי תל אביב-יפו (ת"א 5428-12-10, השופט א' זמיר) מיום 15.9.2013 (שמספרו ע"א 7891/13). ביום 12.12.2013 חתם בית המשפט המחוזי על פסיקתה שנוסחה על ידי המשיבה. על הפסיקתה הגישו המערערות ערעור ובקשת רשות ערעור (ע"א 241/14 ורע"א 243/14). בהמשך להגשת הליכים אלו, הגישו המערערות את הבקשה נושא החלטת הרשם, והמשיבה הגישה מנגד את בקשת המחיקה על הסף.
2.הרשם קבע בהחלטתו כי יש למחוק את ע"א 241/14, כיוון שהפסיקתה, שנקבע במפורש על ידי בית המשפט המחוזי שהיא משקפת את פסק הדין (בהחלטה מיום 12.12.2013), לא מקנה ערעור בזכות, אלא ניתן להגיש עליה בקשת רשות ערעור בלבד, וכך גם עשו המערערות במקביל (רע"א 243/14). כפועל יוצא מקביעה זו, קבע הרשם כי לא ניתן לאחד בשלב זה את ההליכים שפתחו המערערות, וכי רע"א 243/14 תועבר לטיפול שופט.
3.מכאן הערעור שלפניי, במסגרתו טוענות המערערות שאין די בעצם קביעת בית המשפט המחוזי כי מדובר בפסיקתה משקפת כדי לקבוע את סיווגה, אלא על הרשם לבחון את הפסיקתה גופה, בטרם יכריע בשאלה, תוך שהן נסמכות על הפסיקה הנוהגת ושיקולים של מדיניות שיפוטית. עוד טוענות המערערות, כי החלטת הרשם סוטה מהכלל שלאור חשיבות זכות הערעור, יש להעדיף פרשנות המקיימת אותה על פני זו השוללת אותה. עוד הן טוענות כי אין בעובדה כי הן מערערות על עצם התאמת הפסיקתה לפסק הדין, כדי למנוע את הבחינה הלכאורית של ההתאמה על ידי הרשם, לשם סיווג ההליך. לגופו של עניין, טוענות המערערות כי הפסיקתה אינה משקפת את פסק הדין, ולכן יש להן ערעור בזכות עליה.
4.בתגובתה, המשיבה טוענת כי יש לדחות את הערעור. לטענתה, צדק הרשם כאשר התבסס על קביעתו של בית המשפט המחוזי כי מדובר בפסיקתה התואמת את פסק הדין, ודאי לנוכח העובדה שהמערערות טענו את טענות הערעור גם בבית המשפט המחוזי. עוד מדגישה המשיבה כי השופט שחתם על הפסיקתה הוא גם השופט שכתב את פסק הדין, מה שהופך אותו למתאים ביותר להכריע בשאלה. לגופו של עניין, מציגה המשיבה נימוקים לסיווגה של הפסיקתה כמשקפת.
5.כידוע, שיקול הדעת המסור לרשם רחב הוא (בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013); בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012)). שאלת עצם סיווגה של פסיקתה ומשמעותה על דרך ההשגה האפשרית עליה נדונה בבית משפט זה מספר פעמים ונדמה כי התשובה עליה ברורה (ראו: ע"א 3832/10 מיטרני נ' מחלוף (10.8.2010); בש"א 937/13 תשלוז השקעות והחזקות בע"מ נ' עיריית אשקלון, פסקאות 30-29 (9.5.2013)). המערערות טוענות כי הפסיקה הנוהגת מחייבת בחינה מהותית של הפסיקתה והרשם שגה כאשר לא עשה כן. לא מצאתי לטענה זו סימוכין משכנעים. ראשית, החלטות הרשמים אליהן הפנו המערערות הן החלטות המתייחסות לנסיבות המיוחדות של המקרה בפניהם. שנית, ולגופו של עניין, ההחלטות אליהן הפנו המערערות לא חייבו בחינה מהותית של הפסיקתה במקרה כמו זה לפנינו, בו השופט שכתב את פסק הדין ציין במפורש כי הפסיקתה תואמת את פסק הדין, אלא מתייחסות למקרים אחרים עם מערך עובדתי שונה ומורכב, בהם נוספו צדדים או מסמכים לפסיקתה, מה שחייב את בחינתה המהותית.
6.גם לגופו של עניין, מצאתי כי לא נפל פגם בהחלטתו של הרשם. ההחלטה התבססה בעיקרה על החלטתו המפורשת של בית המשפט המחוזי כי מדובר בפסיקתה התואמת את פסק הדין. מבחינת טענות הצדדים, הפסיקתה ופסק הדין, אני סבור כי החלטתו של הרשם נכונה כמהותית. הפסיקתה משקפת את אשר כתוב בפסק הדין, היא קצרה ותמציתית ואינה חורגת מהכתוב בפסק הדין. בנוסף, היא נקבעה כ"תואמת" לאחר שהמערערות העלו בפני בית המשפט את אותן טענות שהן העלו בפני הרשם ומעלות בפניי, ובית המשפט המחוזי, אשר גם נתן את פסק הדין, מצא, כאמור, שהפסיקתה תואמת את פסק הדין. כמובן שאין בדברים אלו כדי להכריע או להשפיע על ההכרעה בשאלות שהעלו המערערות בבקשת רשות הערעור שהגישו על הפסיקתה, אשר עניינה תלוי ועומד (ע"א 243/14).
7.לפיכך, הערעור נדחה. בנסיבות העניין, המערערות תישאנה בשכר טרחת עורכי דינה של המשיבה בסך של 5,000 ש"ח.
