פסק-דין

1.בית המשפט המחוזי בירושלים, בשבתו כבית משפט לפשיטת רגל, הורה על ביטול הענקה לגבי מחצית דירה. מ דובר בהליכי פשיטת רגל, שנפתחו לבקשת נושה, לגבי המשיב 3, הוא החייב. ההענקה בה עסקינן נוגעת למחצית דירה שהחייב העביר לגרושתו, היא המערערת, במסגרת הסכם גירושין.

2.אנו סבורים שיש ממש בערעור, ככל שמ דובר בצורה בה התנהל ההליך בערכאה הדיונית. מתברר, כי בית המשפט לא קיים דיון בבקשה לביטול ההענקה ונתן החלטה מקוצרת. דעתנו היא שבנסיבות העניין ראוי היה לקיים דיון במעמד בעלי הדין. כמו כן ראוי היה ליתן את הדעת על טענתה של המערערת כי במשך השנים שילמה את התשלומים בגין החזר הלוואה לגבי הדירה. ייתכן, בלא שנקבע מסמרות, כי יש להתחשב בתשלומים אלה, במיוחד לגבי תשלומים ששולמו לאחר הסכם הגירושין, במסגרת הבחינה של הבקשה לביטול ההענקה.

לפיכך מתקבל הערעור ופסק-דינו של בית המשפט המחוזי מיום 12.12.2012 מבוטל. ההליך יוחזר לבית משפט קמא לשם דיון בבקשה לביטול ההענקה. כל זאת בלא שנביע עמדה לגופם של דברים. לא ייעשה צו להוצאות.
