פסק-דין

ערעורים על החלטות הרשם ג' שני בבקשות לפטור מתשלום אגרה והפקדת עירבון במספר הליכים שפתחה המערערת.

1.החלטתי לאחד את הדיון בערעורים מכוח תקנה 520 לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן: תקנות סדר הדין האזרחי או התקנות), כיוון שעולות מהם שאלות דומות של עובדה ומשפט.

2.דין הערעורים להידחות. המערערת לא הביאה באף אחד מהתיקים ולו ראשית ראיה לעניין מצבה הכלכלי. לכאורה די בכך כדי לדחות את הערעורים. אך החלטתי אינה מבוססת על תנאי זה, אלא על היעדר עילה וסיכוי של ממש לכל אחד מההליכים שבגינם נתבקשו הפטורים. רק לאחרונה עמדתי בהרחבה על הכללים בעניין פטור מתשלום אגרה והפקדת עירבון (בשג"ץ 4934/14 גורנשטיין נ' הכנסת (21.7.2014)). לענייננו רלוונטי האמור בפסקאות 6 ו-11 שם, והוא שאם נקבע שההליך העיקרי נעדר עילה וחסר סיכוי, אין מקום למתן הפטורים.

3.בש"א 3438/14 הוא ערעור על החלטת הרשם ג' שני (בש"א 3232/14 – א') מיום 8.5.2014 שלא לפטור את המערערת מתשלום אגרה בערעור שהגישה על החלטת הרשמת ל' בנמלך (בש"א 2963/14 – א') מיום 1.5.2014 במסגרתה נדחתה בקשתה להארכת מועד לשם הגשת בקשת רשות ערעור על החלטת בית המשפט המחוזי לפיה נמחקה בקשת רשות ערעור שהגישה, בשל אי תשלום אגרה ואי הפקדת עירבון.

כיוון שלא שילמה המערערת את האגרה, מחק הרשם ביום 26.6.2014 את ההליך העיקרי. משלא הגישה המערערת בקשה לעיכוב ביצוע ההחלטה המקורית, ולא שילמה את האגרה, אין מקום להשיב את הגלגל לאחור, אלא באמצעות ערעור שמופנה כלפי ההחלטה מיום 26.6.2014.

אך גם לגופו של עניין, כאמור לעיל, דין הערעור להידחות. סיכויי ההליך העיקרי בענייננו (בש"א 3232/14) קלושים, שכן גם בענייני קבלת הליכים לרישום מתחם ההתערבות בשיקול דעת הרשם הוא צר, נוכח שיקול הדעת הרחב שמוקנה לו. לכך יש לצרף שמדובר בבקשה שהוגשה חודשים רבים לאחר חלוף המועד להגשת ההליך, ומדובר בבקשת רשות ערעור שמוגשת על בקשת רשות ערעור, שעניינה גם כן באי תשלום אגרה ואי הפקדת עירבון. משכך, צדק הרשם בדחייתו את בקשת המערערת לפטור מתשלום אגרה. יצוין כי הערעור שהגישה המערערת נטול תשתית עובדתית באשר לסיבה בגינה לא הוגש ההליך בזמן, לסיכויי ההליך ואף למצבה הכלכלי. ערעורה עיקרו בהאשמות והשמצות כלפי המשיבים וכלפי בית המשפט שדן בעניינה. הערעור נדחה.

4.בש"א 3592/14 הוא ערעור על החלטת הרשם ג' שני (רע"א 3383/14 – א') מיום 14.5.2014 שדחה את בקשת המערערת לפטור מתשלום אגרה והפקדת עירבון, כיוון שמדובר בהליך שאינו מגלה עילה. ההליך העיקרי בקשת רשות ערעור, שלמיטב הבנתי מהכתוב בה – שאינו סדור או ברור – מופנית כלפי החלטת בית המשפט המחוזי למחוק בקשת רשות ערעור שהגישה המערערת. בקשת רשות הערעור נ מחקה לאחר שהמערערת לא הגישה אותה מנוסחת על פי תקנות סדר הדין האזרחי. ההליך העיקרי אינו מגלה עילה. בבסיס ערעור זה, כמו גם בהליך העיקרי, עומדות האשמות שונות כלפי המשיבים בדבר זיופי חתימות, חריגות בניה, פלישה לרשות היחיד, היזק לרכוש, וגרימת מותו של אביה של המערערת, וזאת ללא כל אסמכתה או תשתית עובדתית. יוער גם כי ההחלטה למחוק את ההליך בבית המשפט המחוזי ניתנה לאחר שהמערערת לא תיקנה את הבקשה כפי שנדרשה לעשות. הערעור נדחה.

5.בש"א 3715/14 הוא ערעור על החלטת הרשם ג' שני (רע"א 3593/14 – א') מיום 21.5.2014 שדחה את בקשת המערערת לפטור מתשלום אגרה והפקדת עירבון כיוון שמדובר בהליך שאינו מגלה עילה, וקבע את סכום העירבון להפקדה על סך של 5,000 ש"ח. יוער כי המבקשת הגישה בקשה שאפסול את עצמי מלדון בעניינה, וביום 10.6.2014 דחיתי את הבקשה.

ההליך העיקרי, בקשת רשות ערעור, מופנית כלפי "כל ההחלטות שקשורות לתיק", כיוון שהמערערת נקנסה בסכום של 1,000 ש"ח לטענתה. בחינתה של ההחלטה של בית המשפט המחוזי (רת"ק 58771-07-13, השופטת י' רז-לוי) מיום 7.5.2014 שצורפה לבקשה, מעלה שעניינה בהוצאות שחויבה בהן המערערת בערכאה אחרת. בית המשפט המחוזי הבהיר כי על המערערת לטעון את טענותיה בלשכת ההוצאה לפועל במסגרת ההליך שמתנהל בעניינה. בנסיבות אלה, ברי כי הליך נוסף בו מתבקשת להתברר אותה הטענה, הוא הליך חסר סיכוי. הערעור נדחה.

6.טרם חתימה אציין כי המערערת מגישה הליכים רבים לבית משפט זה, וככל הנראה בבתי משפט אחרים גם כן (ראו: בג"ץ 856/13 אדלר נ' השר לביטחון פנים (20.2.2013); ע"פ 4826/13 אדלר נ' מדינת ישראל (7.7.2013)). הליכים אלה כולם הם הליכי סרק, אשר מנוסחים בשפה קשה ופוגענית כלפי בתי המשפט, המשיבים וגורמים נוספים. בהחלטה מאוחרת לפסק הדין בבג"ץ 856/13 מיום 4.5.2014, חייב הנשיא גרוניס את המערערת הוצאות לטובת אוצר המדינה בסך של 1,500 ש"ח וציין כי "אם העותרת [המערערת כאן – ס' ג''] תמשיך בהתנהלותה, לא יהא מנוס מחיובה בהוצאות בסכומים הולכים וגדלים" (שם, בפסקה 3 להחלטה). הדבר לא הרתיע את המערערת שהגישה את ההליכים האמורים לאחר מועד זה. אעיר עוד ש רק לאחרונה הכרעתי בהליך נוסף שהגישה המערערת בנפרד, כיוון שהעלה שאלות שונות מהשאלות שההליכים מושא פסק דין זה מעלים (בש"א 3591/14 אדלר נ' האוניברסיטה העברית בירושלים (17.7.2014)).

7.סוף דבר, הערעורים נדחים. המערערת תחויב בהוצאות לטובת אוצר המדינה בסך של 2,000 ש"ח.
