בעקבות המלצתנו הודיעה באת כוחם של המערערים כי אינה עומדת על הערעור. הערעור נמחק איפוא. המערערים ישאו בשכר טרחת עורך דין בסך 7,500 ש"ח לזכות המשיב 2 (מינהל מקרקעי ישראל). לא ראינו מקום לפסיקת הוצאות לזכות המשיב 1.
