פסק-דין

1.ערעור על החלטת בית משפט השלום בחיפה (כבוד השופט א' דורון), מיום 24.7.2013, שלא לפסול עצמו מלדון בת"א 2306-01-12.

2.המשיבים הגישו תביעה כספית נגד המערער בבית משפט השלום בחיפה במסגרתה טענו כי התרשל בתכנון בניית ביתם כמהנדס הפרויקט (קונסטרוקטור). בית המשפט קיים מספר קדמי משפט והתביעה קבועה לשמיעת ראיות. המערער הגיש בקשה לפסילת בית המשפט מלדון בעניינו. טענתו בתמצית הייתה כי דעתו של בית המשפט "ננעלה" כבר בתחילת הדיונים.

3.בקשת המערער נדחתה. בית המשפט קבע כי למעשה כבר מן הדיון הראשון ולכל אורך ההליכים מאז ועד מתן ההחלטה, הייתה עילת הפסלות הנטענת על ידי המערער ידועה לו, ולכן ניתן לדחות את בקשת הפסלות כבר בשל שיהוי. לגוף העניין קבע בית המשפט כי גם אם ייצא מנקודת הנחה שכל טענות המערער נכונות, אין בהן כדי ללמד כי מתקיים המבחן האובייקטיבי בדבר חשש ממשי למשוא פנים או כי הנסיבות אפילו קרובות לכך. בית המשפט העיר כי אף אינו חש שדעתו ננעלה או כי אין עוד טעם בקיום הדיון לפניו. בית המשפט הוסיף כי מרבית ההכרעות בנושאים דיוניים בתביעה ניתנו לטובתו של המערער, לרבות חיוב המשיבים בהוצאות במסגרת הליכים מקדמיים. ממילא, כך נקבע, מ דובר בהכרעות הנתונות לשיקול דעתו ואין בהכרעות בנושאים אלו כדי לבסס עילת פסלות. בית המשפט הוסיף עוד כי בקשת המערער נגועה לכל הפחות במידת מה של היתממות, מאחר שנקודת המוצא הלכאורית של כל בעלי הדין, לרבות המערער עצמו, היא כי תכנון הקונסטרוקציה שביצע כקונסטרוקטור היה לקוי. משכך נקבע כי הניסיון להציג נקודת מוצא זו כ"משחק מכור", נדון לכישלון. לבית המשפט קשה היה להימנע מן התחושה שמ דובר בניסיון של המערער לכבול את ידיו מלנסות לייעל את הדיון, וציין בהקשר זה כי בהמלצתו נמחקו ההודעות לצדדים שלישיים ששלח המערער נגד הקבלן ונגד המפקח על העבודה. בית המשפט סיים בקובעו כי אין מקום שכל הבעת עמדה לכאורית של שופט בהליך אזרחי, בניסיון לייתר שמיעת ראיות, תוביל לפסילתו. בעקבות החלטה זו הוגש הערעור שלפניי.

4.המערער שב וטוען כי ההליכים והדיונים בתביעה נוהלו על ידי בית המשפט באופן שהיה בו כדי להלך אימים עליו, כך שקיים חשש ממשי למשוא פנים בניהול המשפט. התנהלות זו לא הותירה בידי המערער, לטענתו, את "הזכות" לסרב להצעת בית המשפט. לטענת המערער, הוא הגיש את בקשת הפסלות רק לאחרונה משום ששמר על כבודו של בית המשפט וסבר שאין בדיון אחד כדי לקבוע ברמה הראויה בסיס עובדתי אובייקטיבי לכך שדעתו של בית המשפט נעולה. המערער מתאר את התנהלות בית המשפט בדיון הראשון, עת הציע למחוק את ההודעות לצד שלישי שהגיש המערער, באופן שהדגיש את "תוצאות" חיובו של המערער בהוצאות העולות כדי 50,000 ש"ח אם הצעתו לא תתקבל. המערער טוען שהסכים להצעה והניח שעמדת בית המשפט תשתנה בהמשך ההליכים, אך התבדה.

5.לטענת המערער, טעה בית המשפט כשהתייחס לעמדתו כ"היתממות". אכן, המערער הודה באחריות משותפת עם המשיבים וצדדים שלישיים בתכנון לקוי של הקונסטרוקציה, אשר אינו תואם באופן מלא את סוג הקרקע עליה נבנה בית המערערים. המערער מתאר את השתלשלות ההליכים בעניין, ולטענתו, לא הייתה הצדקה להעלאת אפשרות של פסיקת הוצאות אם הצעת בית המשפט לא תתקבל, בוודאי שלא בהיקף כה נדיב של 50,000 ש"ח. ניסיונות המערער ובאת-כוחו לנמק את התנגדותם לא צלחו ולדברי המערער, רק הדגשת היקף ההוצאות על ידי בית המשפט הביאה את המערער להסכים, הסכמה פורמלית, להצעת בית המשפט.

6.לדברי המערער, עצם מחיקת ההודעות לצד שלישי שהגיש אינה תומכת בטענה שההודעות הוגשו מתוך ניסיון לגרור לתביעה "כיסים" נוספים. המערער מוסיף כי הציע לפצות את המשיבים בסכום ראוי, אף בטרם הגישו תביעתם וגם במהלך הדיונים, אך המשיבים סירבו להצעה, סירבו לנהל משא ומתן או לפנות להליך גישור. לטענת המערער, הצעת בית המשפט, שהוצעה גם בדיון האחרון, התעלמה מהתנהלותם של המשיבים. בדיון מיום 11.7.2013 שוב התייחס בית המשפט לאפשרות של פסיקת 50,000 ש"ח לטובת המשיבים כהוצאות ריאליות בתביעה, והוסיף שלדעתו הסכום הראוי לסיום ההליך הוא 88,000 ש"ח וכי הוא ממליץ למערער לקבלו שכן "יחסוך" הוצאות משפט כבדות שיושתו עליו. המערער טוען כי יש בדברים אלו משום נקיטת עמדה ברורה לטובת המשיבים, המעידים שבית המשפט גיבש לעצמו עמדה סופית בעניינו עוד בטרם נשמעו עדים בתביעה. לטענת המערער, ההתראות, ההוראות והקביעות של בית המשפט פוגעים בתחושת הצדק. המערער מתייחס להחלטות דיוניות של בית המשפט, כולל חיוב המשיבים לגלות מסמכים, וטוען, שבית המשפט דחה חלק מבקשה שלו בעניין זה. לטענת המערער, מלכתחילה כפה עליו בית המשפט את הצעתו למחוק את ההודעות לצד שלישי שהגיש, וכי דחיית בקשתו לגילוי יומן העבודה שהיה בבעלות המשיבים התבססה על כך שהקבלן והמפקח אינם צדדים להליך.

7.דין הערעור להידחות. כידוע, השגות על הדרך בה בוחר בית המשפט לנהל את הדיון ועל החלטותיו מקומן בהליכי ערעור רגילים, על פי סדרי הדין, ולא במסגרת הליכי פסלות (ראו למשל, ע"א 5158/13 חמד מפעל לחידוש צמיגים בע"מ נ' תעשיות גומי עין שמר אגח"ש בע"מ (1.8.2013)). על ההחלטות הדיוניות עליהן מלין המערער עליו להשיג בערכאת הערעור, ואין בחוסר שביעות רצונו מהן כדי להקים עילת פסלות. אשר לטענות המערער בנוגע להצעות שהציע בית המשפט, הרי שמ דובר בהצעות שהוצעו על יסוד לכאורי במהלך ישיבות קדם המשפט ואין בהן, כשלעצמן, כדי להקים עילת פסלות. מ דובר בהצעות שנועדו לייעל את הדיון בטרם שמיעת הטענות והבאת כל הראיות, ומתוך ניסיון לפשר בין בעלי הדין ולסיים את הסכסוך (השוו: ע"א 7756/12 מרצ'נקו נ' בוני (18.11.2012)). מ דובר, כאמור, בהצעות שהציע בית המשפט על יסוד התרשמות שאינה סופית. אכן, אפשר שבראייתו של המערער נוצר חשש כי הצעותיו של בית המשפט והתנהלותו מצביעות על קיום חשש ממשי למשוא פנים, עם זאת, חשש זה אינו יוצא מכלל חשש סובייקטיבי גרידא שאינו מקים עילת פסלות על יסוד מבחן אובייקטיבי (למשל, ע"א 6664/12 ביטון נ' הראל חברה לביטוח בע"מ (28.10.2012). בשולי הדברים ומלמעלה מהצורך אעיר כי יש ממש בקביעת בית המשפט לפיה השתהה המערער בהגשת בקשת הפסלות.

כאמור, דין הערעור להידחות וכך מוחלט. מאחר שלא הוגשה תשובה, לא ייעשה צו להוצאות.
