פסק-דין
1.לבית המשפט המחוזי בירושלים הוגשה על ידי המשיבים 1-3 תובענה, על דרך המרצת פתיחה, בה הוא התבקש לקבוע כי אין תוקף לשני יפויי כוח נוטריונים שנחתמו בפני המשיב 5. בית המשפט קיבל את התובענה ואכן קבע כי אין תוקף ליפויי הכוח. בערעור משיגה המערערת על קביעתה של הערכאה הדיונית.
2.דעתנו היא כי דינו של הערעור להידחות. השאלה שהונחה לפתחה של הערכאה הדיונית היתה שאלה עובדתית בעיקרה. בית המשפט מצא כי יפויי הכוח, הכתובים בשפה הרומנית, נחתמו על ידי המשיבים 3-1 בלא שהמסמכים תורגמו להם. עוד נקבע כי השלושה אינם יודעי השפה הרומנית. כמו כן התברר כי נפלו פגמים רבים בהתנהלותו של המשיב 5. כך הוא לא ניהל כרטסת או ספר נוטריון ואף לא שמר בידיו העתקים של המסמכים, והכל בניגוד לחובותיו לפי חוק הנוטריונים.
חרף טענותיו של בא כוח המערערת, הרי דעתנו היא שעסקינן בערעור על ממצאי עובדה, שאין דרכה של ערכאת הערעור להתערב בהם. בהקשר זה אף נציין כי המשיב 5 הודה בשלב מסוים כי הוא לא תרגם את המסמכים למשיבים 3-1.
3.נעיר, כי המשיבים 1 ו-2 הוכרזו פושטי רגל. הכונס הרשמי משמש כנאמן לנכסיהם. עו"ד אורי חורש משמש כמנהל מיוחד. עו"ד חורש התייצב היום בפנינו והודיע כי עמדתו היא שיש לדחות את הערעור.
4.משנמצא כי אין מקום להתערב בממצאי העובדה, הננו דוחים את הערעור ללא צו להוצאות.
