הויתור על ההוצאות כאמור בסעיף 1 לעיל והתשלום האמור בסעיף 2 לעיל, ייעשו במקביל ובכפוף למחיקת הערות האזהרה כאמור בסעיף 3 לעיל. המשיבים יפקידו בידיו הנאמנות של בא כוחם את הסכום של 30,000 ₪, ובא כוחם יעבירו לבא כוח המערער כנגד אסמכתא על מחיקת הערות האזהרה.

הצדדים הודיעו לתיק בית המשפט כי הם מקבלים הצעת בית המשפט שהועלתה לפרוטוקול בישיבה מיום 24.5.2011. יש להצר על כך שהצדדים "מתכתבים" עם תיק בית המשפט במקום לגבש נוסח מוסכם ולהגישו חתום לבית המשפט. משלא עשו זאת הצדדים, אעשה זאת עבורם ואני מורה אפוא כלהלן:
1.המשיבים יוותרו על ההוצאות בסך 90,000 ₪ שנפסקו לזכותם ב בית משפט קמא וייסגר תיק ההוצאה לפועל שנפתח כנגד המערער. בשלב זה, ועד למחיקת הערות האזהרה כאמור בסעיף 3 להלן, יעוכבו הליכי ההוצאה לפועל.
2.המשיבים יוסיפו וישלמו למערער 30,000 ₪ כנגד ויתור על טענתו לגבי זכויותיו בחדר.
3.על מנת לאפשר השלמת העסקאות ברישום, המערער יגרום - תוך 12 חודשים מיום פסק דין זה - למחיקת הערות האזהרה הרשומות כלהלן:
א. חלקה 3 בגוש 7875 שטר מס' 0029420001 (2542/98/1) מיום 22 בפברואר 1998, שנרשמה לטובת אחמד תאיה, אמין תאיה, סיף אלדין תאיה ויוסף תאיה על הבעלות של אמנה מוחמד תאיה ז"ל.
ב. חלקה 40 בגוש 7864, שטר מס' 0029410002 (2541/98/2), מיום 22 בפברואר 1998, שנרשמה לטובת אחמד תאיה, אמין תאיה וסיף אלדין תאיה על הבעלות של אמנה מוחמד תאיה ז"ל.
4.הויתור על ההוצאות כאמור בסעיף 1 לעיל והתשלום האמור בסעיף 2 לעיל, ייעשו במקביל ובכפוף למחיקת הערות האזהרה כאמור בסעיף 3 לעיל. המשיבים יפקידו בידיו הנאמנות של בא כוחם את הסכום של 30,000 ₪, ובא כוחם יעבירו לבא כוח המערער כנגד אסמכתא על מחיקת הערות האזהרה.
