פסק-דין

בהתאם להסכמת הצדדים אני מורה כלהלן:

1.הערעור נדחה ללא צו להוצאות. הפיקדון יוחזר למפקידו.

2.הדירה נשוא התובענה ב בית משפט קמא, ברחוב בן אליעזר 23 רמת גן, הידועה כגוש 6183 חלקה 217/3 (להלן: הדירה) תימכר על ידי כונס הנכסים שמונה בתיק הוצל"פ 01-15947-80-1 למימוש המשכנתא שנרשמה על הדירה בהתאם לפסק הדין נשוא הערעור, על פי הסכם המכר שיוגש לאישור כבוד רשם ההוצאה לפועל, במסגרתו רוכש הדירה, על אחריותו וחשבונו, התחייב להעניק למערערים דיור חלוף על ידי העמדת הדירה למגוריהם במשך 5 שנים והמערערים מצידם התחייבו להשיג פטור ממס שבח מקרקעין.
