השופט י' עמית:
1.המנוח ממן חביב ז"ל (להלן: המנוח), יליד 25.3.1973, נהרג בתאונת דרכים ביום 11.5.2006 והותיר אחריו אלמנה ילידת 7.6.1976 ובן יליד 14.5.2005 הם המשיבים והמערערים שכנגד שבפנינו (להלן: המשיבים). המשיבים הגישו ב בית המשפט המחוזי בחיפה תביעה לפי חוק הפיצויים לנפגעי תאונות דרכים, התשל"ה-1975, בגין הנזקים שנגרמו להם עקב מותו של המנוח.
בית משפט קמא חישב את נזקי העזבון על פי שיטת הידות (5 ידות) ועל פי הכללים המקובלים, לפי בסיס שכר של 7,000 ₪ נטו למנוח ובסיס שכר של 3,500 ₪ נטו לאלמנה, ובהתאם לכך הועמדה הקופה המשותפת על סך של 10,500 ₪. בנוסף, פסק בית משפט קמא את הסכום המכסימלי המגיע לעזבון בגין נזק ללא ממוני; בגין הוצאות אבל ומצבה 20,000 ₪; בגין אובדן שרותי אב ובעל בתביעת התלויים סך של 200,000 ₪. סך הכל נפסק לזכות המשיבים 1,721,899 ₪, ומסכום זה נוכתה קיצבת השארים בסך 561,248 ₪.
על כך נסב הערעור והערעור שכנגד שבפנינו.
2.הערעור מתמקד בעיקר בקביעת שכר הבסיס של המנוח, באשר בהתאם לתלושי השכר השתכר המנוח כ-4,000 ₪ נטו. המערערת הלינה על כך ש בית המשפט קיבל למעשה את טענת האלמנה כי המנוח השתכר סכום נוסף בהכנסה לא מדווחת, מבלי שהונחה תשתית ראייתית לכך. ואילו בערעור שכנגד נטען כי היה על בית משפט קמא להעמיד את הכנסת המנוח על סך 9,000 ₪ נטו.
אומר בקצרה כי דין הערעור והערעור שכנגד להדחות. אכן, כעניין שבמדיניות משפטית ראויה, על בית המשפט להידרש לרף ראייתי של ממש מקום בו נטען להכנסה לא מדווחת. במקרה דנן, המערער עבד במזנון-מסעדה בבית החולים "זיו" בצפת, והעסק היה בבעלותו של אביו ושל שותף נוסף, וכפי שנטען, מהעסק התפרנסו מספר משפחות. בית משפט קמא אשר שמע את האלמנה ואחותה, התרשם לחיוב מעדותן, ממנה עלה, בין היתר, כי המנוח השתכר פרט למשכורתו, "שווה כסף שבא לידי ביטוי במזון, סיגריות, רכב ותשלום הוצאות חריגות". בקביעה זו, המכמתת את שווי טובות ההנאה שקיבל המנוח מאביו ובני משפחתו במסגרת עבודתו בעסק, איני רואה להתערב, לא להפחתה ולא להגדלה, ומשכך, דין הערעור והערעור שכנגד להידחות.
3.בפסק דינו של בית משפט קמא נפלה טעות בכך שניכה את התשלומים התכופים מבלי "לחלץ" שכר טרחת עורך דין. במצב הדברים הרגיל היה מקום להורות על תיקון פסק דינו של בית משפט קמא בנקודה זו, המהווה טעות קולמוס, אולם טעות זו "מתקזזת" עם טעות שנפלה לחובת המערערת עקב חישוב הפסדי ההשתכרות עד גיל 70 במקום עד גיל 67, כך שאין הצדקה להתערבות ערכאת הערעור.
4.אשר על כן, אני דוחה את הערעור והערעור שכנגד ללא צו להוצאות.
