ערעור על פסק דינו של בית המשפט המחוזי תל אביב בתיק פרק 2097/04 שניתן ביום 06.05.2012 על ידי כבוד השופטת ו' אלשיך

בהמלצת בית המשפט, הגיעו הצדדים להסכמה כלהלן:
1.החלטת בית משפט קמא תבוטל ועימה יבוטלו הקביעות העובדתיות ככל שהן מתייחסות לעו"ד יוחאי.
2.לפנים משורת הדין, ובהתחשב באי ההבנה שנוצרה לגבי עמדת עו"ד יוחאי, נכון עו"ד יוחאי לשלם למערערת סך 5,000 ₪.
3.בנוסף, עו"ד יוחאי מצהיר ומתחייב לסייע ככל שביכולתו למערערת ולבא כוחה על מנת להשלים את רישום הדירה על שמה. כיום, ככל שהבינותי מהמערערת, רשומה לזכותה הערת אזהרה בלבד אשר ככל הנראה נחתמה ע"י עו"ד מטרי. ככל הנראה, על מנת להשלים את רישום הדירה על שמה, יש צורך בחתימה על שטר מכר אשר כולל את השרשרת חברה בפירוק-חברת דלקס-ארביב-המערערת. ככל הנראה, יש את כל יפויי הכח הדרושים מהחברה, מארביב ומהמערערת, אך חסר יפוי כח מחברת דלקס. עו"ד יוחאי הצהיר בפני כי בדק במשרדו ולא מצא יפוי כח כאמור, אך הוא יודע מי הבעלים של חברת דלקס ומסוגל ליצור איתו או עם בא כוחה קשר, וכי בהתאם להמלצת בית המשפט יעשה כן על מנת לקבל יפוי כח מדלקס. עו"ד יוחאי יעדכן את גב' בונן או בא כוחה מעת לעת בנושא.
