ערעור על החלטת הרשמת ל' בנמלך (ע"א 1167/14) מיום 4.3.2014, במסגרתה דחתה את בקשת המערערת לפטור מאגרה והפקדת עירבון בהליך האמור, אך הורתה להפחית את האגרה לסך של 100 ש"ח, והעמידה את העירבון על סך של 1,500 ש"ח.

1.המערערת הגישה לבית משפט זה ערעור על החלטת בית המשפט המחוזי בתל אביב-יפו (פש"ר 1809/06, השופט א' אורנשטיין) מיום 29.12.2013. בגדרי החלטה זו דחה השופט אורנשטיין את הבקשה כי יפסול את עצמו מלדון בעניינו של בעלה של המערערת. בד בבד עם הגשת הערעור, הגישה המערערת בקשה לפטור מאגרה והפקדת עירבון.

2.בהחלטתה קבעה הרשמת, בין השאר לנוכח תגובות המשיבים שהצביעו על תמיהות שעולות מהבקשה, כי המערערת לא פרשה תשתית עובדתית מלאה להוכחת מצבה הכספי, מלבד צירוף פטור מתשלום אגרה שניתן לה בהליך קודם (בג"ץ 877/14). עוד קבעה הרשמת כי לעניין הפטור מהפקדת עירבון, המערערת לא הוכיחה שאינה יכולה לגייסו בעזרת סביבתה הקרובה. לעניין סיכויי ההליך נקבע ש"המשוכה הניצבת בפני המערערת גבוהה ביותר".

3.מכאן הערעור שלפניי, במסגרתו טוענת המערערת שדי בתצהיר שהגישה לפיו אין לה רכוש על שמה, כרטיס אשראי, חשבון בנק פעיל או כל תוכנית חיסכון ואין מקום להבהרה נוספת מצידה, וכן כי הפטור שניתן לה בהליך קודם (כאמור, בג"ץ 877/14) מוכיח זאת. לטענתה, תגובות המשיבים, עליהן התבססה הרשמת בהחלטה, רצופות שקרים. עוד טוענת המערערת כי גם אין מקום לדרוש ממנה שתבקש סיוע ממשפחתה, לנוכח מצבה הבריאותי הקשה. באשר לסיכויי ההליך מסכימה המערערת עם קביעת הרשמת, כיוון ש"עד היום קשה להאמין בבתי משפט". בנוסף, טוענת המערערת כי לא קיבלה את תגובות המשיבים ולא ניתנה לה אפשרות להגיב עליהן.

4.דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשמת. כידוע, שיקול דעתה של הרשמת רחב, ולא בנקל תתערב בו ערכאת הערעור (בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013); בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012)). במסגרת הבקשה לפטור מאגרה, על המבקש להוכיח את אי יכולתו לשלמה, ולצרף את פירוט מקורות הכנסתו בששה החודשים שקדמו למועד הבקשה (תקנה 14א לתקנות בתי המשפט (אגרות), תשס"ז-2007; ראו גם: רע"א 8804/11 שוקר נ' INSPECS LTD, פסקה 3 (24.4.2012)). המערערת לא עשתה כן בבקשתה, וגם לא בערעורה. נוסף לכך, לא הבהירה את התמיהות שעלו מתגובות המשיבים לבקשתה, מהן ניתן להסיק כי מצבה הכלכלי שונה מזה שהיא מצביעה עליו.

5.בנוסף, במסגרת בקשה לפטור מהפקדת עירבון, על המבקש הנטל להוכיח שני תנאים מצטברים: היעדר מסוגלות כלכלית וסיכויי ההצלחה בערעור (בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי, פסקה 7 (17.10.2007)). בין היתר, המבקש נדרש להוכיח כי אין ביכולתו לגייס כספים מחבריו וקרוביו לטובת הפקדת העירבון שנקבע (ראו: בש"א 6411/11 שני נ' עו"ד ארז חבר, נאמן לנכסי החייב (3.10.2011)). המערערת לא הציגה שום הוכחה לעניין זה ואף טוענת בערעורה שאין מקום לבקש זאת ממנה. כל אלה עומדים לחובת המערערת עוד טרם התייחסתי לסיכויי הערעור, שעניינו פסלות שופט, שאינם מן המשופרים, באופן כללי ובנסיבות העניין.

6.אציין גם כי למרות טענת המערערת שלא יכולה הייתה להגיב לתגובות המשיבים, למעשה היא הגיבה להן, ואף הגישה בקשה לעיון חוזר, ולגביהן ניתנה החלטת הרשמת ביום 12.3.2014. במצב עניינים זה, החלטת הרשמת להפחית את האגרה והעירבון לסכומים המתוּנים שקבעה, מאזנת נכונה בין השיקולים השונים.

7.סוף דבר, הערעור נדחה. המערערת תשלם את האגרה ותפקיד העירבון, עד ליום 1.5.2014. לא תעשה כן, יירשם ההליך לדחייה ללא כל הודעה נוספת. בנסיבות העניין, אין צו להוצאות.
