השופט נ' סולברג:

1.במוקד העתירה, האבטחה המשטרתית באירועי "שבת האור".

2.בעתירתם ביקשו העותרים לצוות על המשטרה להימנע מחסימת הכניסות לעיר העתיקה בירושלים ביום האירוע; להפחית במידה רבה את מספר השוטרים המיועדים לאבטחת האירוע, למנוע את כניסתם של שוטרים חמושים אל מתחם כנסיית הקבר הקדוש; למנוע מהמשטרה לפנות את הכיכר שמול כנסיית הקבר. בתמצית: לטענת העותרים, מעורבות-יתר של המשטרה צפויה להכביד על החוגגים, להעכיר את שמחת החג, והיא איננה נחוצה. העותרים טוענים כי אין צורך בפריסה המשטרתית המתוכננת, וכי מן הראוי לחזור למִתווה שהיה נקוט בידי המשטרה עד לשנת 2005.

3.מנגד טענה משטרת ישראל כי אין מקום להתערבותו של בית המשפט בשיקול דעתה המקצועי, כמי שאמוּנה על הבטחון, הבטיחות והסדר הציבורי. מפכ"ל המשטרה אישר את פקודת המבצע על דעת השר לבטחון הפנים, בשים לב למספר החוגגים הצפוי (כ-30,000 – 40,000 מבקרים מכל העולם, מתוכם כ- 10,000 הצפויים להיכנס אל תוך כנסיית הקבר). רגישות רבה מתחייבת גם לנוכח האופי הדתי של האירועים ומרקם היחסים העדין בין העדות הנוצריות בעיר העתיקה. המשטרה קשובה לפניות העותרים ולטענותיהם, נכונה לסייע להם במצוקתם, ולגבש בצוותא פתרונות מעשיים לשם הגעת ציבור המאמינים אל סביבת כנסיית הקבר במהלך אירועי "שבת האור". המשטרה גם הציעה להעמיד קצין משטרה יעודי על מנת שיתלווה אל נציגי העותרים ואנשיהם במהלך האירוע, על מנת ליתן מענה לבעיות שיכולות להתעורר בזמן אמת.

4.בעתירתם טענו העותרים ארוכות, ותגובת המשיבים התייחסה בפרטוּת לכל הטענות. מפאת קוצר הזמן, ומשום שבמרבית הנושאים הושגה הסכמה, לא נרחיב עוד בטענות מזה ומזה. גם ההלכה הפסוקה לעניין התערבותו של בית משפט זה בשיקול דעתה של המשטרה ברורה וידועה. העיקר הוא, שבעקבות המלצתנו אתמול התכנסו באי-כוח הצדדים ושולחיהם מחוץ לאולם בית המשפט למשך כמה שעות, והגיעו להסכמות באופן שמייתר דיון והכרעה בטענות שבעתירה. מספר נקודות נותרו אמש במחלוקת, הערנו לגביהן את אשר הערנו, ולאחר הדיון ביקשנו להמשיך בניסיון להגיע לעמק השווה. בצהרי היום הוגשה הודעה מעדכנת. עיקרהּ – הסכמות, אם כי נותרו עדיין חילוקי דעות מסויימים.

5.ניתן בזאת תוקף של פסק דין לשורת ההסכמות החלקיות שפורטו בהודעה המעדכנת מהיום (סומנה א). לבקשת ב"כ העותרים בהודעתו, רשמנו לפנינו את נקודות המחלוקת העיקריות אשר נותרו בין הצדדים (סומנה ב). ב"כ העותרים הודיע כי אינם מבקשים מאיתנו להכריע בנקודות המחלוקת הללו, והצטרף לבקשת המשיבים למחוק את העתירה.

6.ראויים ב"כ הצדדים, הם ושולחיהם, המשטרה מזה, והעותרים מזה, להערכה, על ההתייחסות הרצינית והסבלנית לעניינים שבמחלוקת, התייחסות שהביאה ליישוב מרבית הנושאים באופן שהניח את דעתם של כולם.

7.העתירה נמחקת אפוא בזאת.

אין צו להוצאות.
