המשנה לנשיאה א' ריבלין:

בפנינו שתי עתירות בהן מתבקש צו המורה למשיבים להוסיף את ועדות הערר לענייני ארנונה, הפועלות מכוח חוק הרשויות המקומיות (ערר על קביעת ארנונה כללית), התשל"ז-1976, לתוספת לחוק לבתי-דין מנהליים, התשנ"ב-1992, כך שהוראות חוק זה האחרון יחולו על ועדות הערר האמורות. בעתירות התבקשו סעדים נוספים: התקנת תקנות להבטחת שמירת כללי הצדק הטבעי בועדות הערר (בג"ץ 10285/06) ומתן הוראה על-ידי שר המשפטים כי מחלוקת על החלטת ועדות הערר תתברר בדרך של עתירה מנהלית (בבג"ץ 591/07).

בשל הסעד הדומה שהתבקש בשתי העתירות, אוחד הדיון בהן. פסק-הדין אף הוא מתייחס לשתי העתירות בצוותא-חדא.

העותרים מעלים השגות שונות באשר למתכונתן הנוכחית של ועדות הערר, ובכלל זה, לעניין קיומו של ניגוד העניינים בקרב חברי הוועדה, לעניין היעדר כשירותם של האחרונים למלא את תפקידם, לעניין תלותה של ועדת הערר וחבריה בראשות המקומית וכן טענות נוספות הנוגעות בעיקרו של דבר לקיום כללי הצדק הטבעי.

המשיבים הודיעונו כי בעת הזו מתקיימים הליכים לקידום הצעת חוק העיריות, התשכ"ז-2007 – אשר תכלול הסדר חדש בנושא הנדון. הצעת החוק עוסקת, בין היתר, בהרכבה של הוועדה, בכשירות חבריה, במניעת ניגוד עניינים, במשך תקופת הכהונה של חברי הוועדה וכן בעניין סמכותו של שר המשפטים לקבוע כללים לתשלום גמול לחברי הוועדה. המשבים סבורים כי בהצעת החוק יש כדי ליתן מענה לרוב הבעיות המועלות על-ידי העותרים.

לאחר ששמענו את טענות הצדדים ושקלנו בדבר, באנו לכלל מסקנה כי בהצעת החוק המ דובר ת יש כדי ליצור הסדר חדש, בכל הנוגע לסוגיות המועלות בעתירות. בנסיבות אלה אנו סבורים כי אין מקום לקיים דיון בטענות העותרים דהיום – והכל בהנחה שאכן, בתוך זמן סביר, יושלמו הליכי החקיקה ברוח הדברים המפורטים בתשובת המשיבים.

העותרים אמנם מעלים את החשש שגם ההסדר המוצע, אם יתקבל, לא יציע מענה למכלול ההיבטים שהוכללו בעתירה. זאת אין לדעת היום ואם כך יהיה – שמורה תמיד לעותרים הזכות לפנות בעתירה מתאימה, אם יהא לכך בסיס בדין.

לפיכך, החלטנו למחוק את העתירות. ככל שלא יושלמו הליכי החקיקה בתוך זמן סביר או שהליכי החקיקה יושלמו אך לא יניחו את דעתם של העותרים, יוכלו הם לפנות לבית-המשפט בעתירה חדשה, בהתאם למצב המשפטי הרלוונטי. בנתון להערה זו, העתירות נמחקות. בנסיבות העניין, אין צו להוצאות.
