משאמרנו מה שאמרנו נוסיף את הדברים הבאים: ברי, כי חובתו של המשיב לדאוג אף לביטחונם של תושבי נגוהות. כאמור, עם פתיחתו של כביש הרוחב לתנועה של פלסטינים נקט המשיב צעדים חדשים על מנת להבטיח את ביטחונם של תושבי נגוהות ושאר המשתמשים בכביש הרוחב. אם סוברים תושבי נגוהות כי הצעדים החדשים אינם מספיקים רשאים הם, כמובן, לפנות למשיב. אנו סמוכים ובטוחים כי המשיב יאזין להשגותיהם של תושבי נגוהות וכי בכל מקרה בוחן הוא מעת לעת את סידורי הביטחון בהתחשב בנתונים המשתנים.

2.המשיבים 6-2 הגישו בשנת 2006 עתירה לבית המשפט הגבוה לצדק (בג"ץ 3969/06). בעתירה הם הלינו על החלטה של המשיב 1 דכאן, הוא המשיב 1 בבג"ץ 3969/06 (להלן – המשיב), לאסור תנועה של פלסטינים תושבי יהודה ושומרון בכביש 3265. הכביש האמור הינו כביש רוחב, שכיוונו מערב-מזרח. כביש זה חוצה צומת הנקרא צומת בית עווא. הצומת מהווה נקודת מפגש בין כביש הרוחב לבין כביש האורך 354. היישוב הישראלי נגוהות צמוד לכביש הרוחב, במרחק של כ- 4 ק"מ מזרחית לצומת בית עווא. הכפר הפלסטיני פוקיקיס נמצא מזרחית לנגוהות. העותרת בעתירה שבפנינו הינה אגודה שיתופית המאגדת את תושבי נגוהות, המונים כ-150 נפשות. המשיב אסר על תנועה של תושבים פלסטינים בקטע של כביש הרוחב מזרחה עד לכפר פוקיקיס. הישוב נגוהות ותושביו לא צורפו כמשיבים בעתירה בבג"ץ 3969/06. ביום 22.10.09 החליט בית משפט זה להפוך למוחלט את הצו על-תנאי שהוצא בבג"ץ 3969/06. נקבע כי הצו שהוצא על ידי המשיב, ואשר לפיו נסגר כביש הרוחב לתנועה של פלסטינים "אינו מידתי במתכונתו הנוכחית". עוד הורה בית המשפט שפסק הדין ייכנס לתוקף בתום שלושה חודשים "על-מנת לאפשר למפקד הצבאי לגבש פיתרון ביטחוני אחר, אשר יוכל לספק הגנה לתושבים הישראליים העושים שימוש בכביש הרוחב".
3.בעתירה שבפנינו טענה העותרת, כי פסק הדין מיום 22.10.09 ניתן בלא שהעותרת ותושבי נגוהות היו משיבים בעתירה, אף שהתוצאה של פסק הדין פגעה בהם, בזכויותיהם ובביטחונם. בתגובתו של המשיב לעתירה נטען, כי פרקליט העותרת דכאן וכן העותרת היו מודעים להליך הקודם בבג"ץ 3969/06, אך למרות זאת הם לא ביקשו להצטרף כצד באותו הליך. עוד נטען כי בפועל, במסגרת תצהיר התשובה של המשיב בבג"ץ 3969/06, הושם דגש על הצגת האינטרסים של תושבי הישוב נגוהות, כמו של ישראלים אחרים שהשתמשו בכביש הרוחב.
4.בהודעת עדכון שניתנה על ידי המשיב ביום 18.2.2010 (לאחר הגשת תגובתו לעתירה דנא), הוא מסר כי כביש הרוחב נפתח לתנועה של פלסטינים לאור פסק הדין בבג"ץ 3969/06. עוד מסר המשיב כי נעשו פעולות שונות במטרה להבטיח את התנועה של המשתמשים בכביש הרוחב, כולל כמובן תושבי נגוהות. בין היתר הוגדל מספר הלוחמים המגינים על הישוב ועל המרחב והאוטובוסים המשרתים את תושבי הישוב הוחלפו לאוטובוסים ממוגנים.
5.העתירה שבפנינו הינה יוצאת דופן משהו. כפי שראינו, בית משפט זה נתן צו מוחלט ולפיו בוטלה החלטתו של המשיב לאסור נסיעה של פלסטינים בכביש הרוחב, זאת מן הטעם שמדובר בצעד בלתי מידתי. השאלה הראשונה המתבקשת היא האם לאחר שניתן צו מוחלט רשאי בית משפט זה לבטל את פסק הדין שנתן. התשובה לשאלה זו הינה חיובית. כאשר בית משפט נותן החלטה או פסק דין הפוגעים באופן ישיר וממשי בזכותו של אדם או גוף שלא היו בעלי דין, רשאי אותו בית משפט לבטל את ההחלטה או פסק הדין. הכלל האמור מוכר וידוע בתחום המשפט האזרחי (יואל זוסמן סדרי הדין האזרחי 734 (מהדורה שביעית, 1995)). הדרך המקובלת בה הנפגע צריך לפעול במקרה כזה היא להגיש תובענה לביטול פסק הדין (ע"א 701/76 עפרון נ' חברת הכשרת הישוב בישראל בע"מ, פ"ד לא(3) 79, 81 (1997)). מה הדין כאשר מועלית טענה שפסק דין שניתן על ידי בית המשפט הגבוה לצדק פגע באופן ישיר וממשי במי שלא היה בעל דין? התשובה היא שהנפגע רשאי לפנות לאותו בית משפט על מנת שיבטל את פסק הדין וידון מחדש בעניין. על כן, הדרך בה הלכה העותרת הינה נכונה מבחינה דיונית. ברם, וכפי שיוסבר עתה, קיימים מקרים בהם חרף הפגם שנפל לא יבטל בית המשפט את ההחלטה או פסק הדין שניתנו.
6.המקרה הבולט ביותר הוא זה בו נתברר כי הטוען לפגיעה ידע על ההליך הקודם, אך לא ראה לנכון לבקש להצטרף כבעל דין (בג"ץ 353/67 "אגד" אגודה שיתופית לתחבורה בישראל בע"מ נ' שר התחבורה, פ"ד כב(1) 332 (1968)). כך אכן אירע במקרה שבפנינו. ביום 24.5.07, בעת שהעתירה בבג"ץ 3969/06 הייתה תלויה בבית משפט זה, שלח עורך דין נ' ורצברגר, המייצג את העותרת בעתירה דנא, מכתב לאלוף פיקוד המרכז. במכתב נטען כי לתושבי הישוב נגוהות ניתנה הבטחה שילטונית לפיה תהא תנועה חופשית בכביש הרוחב מן הישוב מזרחה. עוד נאמר במכתב כי חרף זאת הכביש נחסם באורח קבע. המכתב האמור נשלח על ידי הפרקליט הנכבד בשם אירגון זכויות האדם ביש"ע. העתק הימנו הועבר למזכירות של הישוב נגוהות. ביום 3.6.2007 נשלחה תשובה לעורך דין ורצברגר. אין צורך להידרש לפרטי התשובה. הנקודה החשובה בענייננו היא שבתשובה נזכרה העתירה בבג"ץ 3969/06 ואף צורף תצהיר התשובה שהוגש שם. במכתב התשובה מצוין במפורש כי תושבי נגוהות לא צורפו כמשיבים לעתירה. לא יכול להיות ספק לאור האמור כי תושבי נגוהות אכן ידעו על דבר ההליך הקודם. אף על פי כן, הם לא ביקשו להצטרף כמשיבים באותה עתירה. בנסיבות אלה מנועים הם מלהלין עתה על פסק הדין בבג"ץ 3969/06 (בג"ץ 353/67 הנ"ל, שלמה לוין תורת הפרוצדורה האזרחית: מבוא ועקרונות יסוד 245 (מהדורה שניה, 2008)).
7.משאמרנו מה שאמרנו נוסיף את הדברים הבאים: ברי, כי חובתו של המשיב לדאוג אף לביטחונם של תושבי נגוהות. כאמור, עם פתיחתו של כביש הרוחב לתנועה של פלסטינים נקט המשיב צעדים חדשים על מנת להבטיח את ביטחונם של תושבי נגוהות ושאר המשתמשים בכביש הרוחב. אם סוברים תושבי נגוהות כי הצעדים החדשים אינם מספיקים רשאים הם, כמובן, לפנות למשיב. אנו סמוכים ובטוחים כי המשיב יאזין להשגותיהם של תושבי נגוהות וכי בכל מקרה בוחן הוא מעת לעת את סידורי הביטחון בהתחשב בנתונים המשתנים.
