פסק-דין

העותרת מבקשת מעמד מכוח שבות. טענותיה נתבססו על שלושה אדנים, טענת היותה בת לאב יהודי, טענת היותה אלמנת יהודי וטענת גיור. שתי הטענות הראשונות לא נתקבלו על דעת המשיב במישור העובדתי, בשל סימני שאלה על המסמכים לענין יהדותו של האב ובשל סימני שאלה הקשורים במכלול הנישואין (זמן קצר עד למות הבעל שהיה מבוגר ממנה ב-18 שנים, ובן 88 לעת הנישואין, וחלוף זמן מאז). באשר לגיור, הוצגה תעודת גיור משנת 2011 אך לא אושש לעת הזאת הקשר לקהילה אליה משתייכת העותרת לכאורה ברוסיה (סנט פטרבורג).

גורמי המשיב נכונים, ככל שחומר כזה יוצג במהרה, לדון בו בלא שיהוי נוכח גילה של העותרת (83, עד מאה ועשרים).

רשמנו לפנינו זאת ובנתון לכך נמחקת העתירה, בלא צו להוצאות.
