השופט א' רובינשטיין:

העותרת 1 ויתרה על אזרחותה הישראלית ב-1984. במסמכי התקופה ההיא הודיעה תחילה על ויתור על האזרחות בשל נישואיה ורצונה לגור עם בעלה באיזור, תוך כוונה לנסוע בעתיד לחו"ל (מסמך מש/2, 3.3.84), אך במסמך מש/4 מ-25.3.84 הודיעה על כוונת נסיעה לירדן. לטענת העותרת לא התכוונה בעת ההיא לצאת לחו"ל, ויצאה לירדן רק כעבור שנים רבות, ועל כן לא היה מקום לויתור על אזרחותה. לשיטת המשיבים היה הויתור רצוני וכהלכתו.

סבורים אנו כי הנוהל הידוע כנוהל "דוניא עאבד" אינו חל כאן, כיון שהוא נקבע מטעמים הומניטריים לנשים שויתרו על אזרחות ישראלית ועברו לאיזור אך לימים נתאלמנו או התגרשו וזיקתן לאיזור פחתה, וביקשו לשוב לעוגן המשפחתי בישראל. נוהל זה אושר פעם אחר פעם בפסיקתו של בית משפט זה. במקרה דנא העותרת אינה אלמנה או גרושה, אלא - השבח לאל - חיה עם בעלה ומשפחתה. המסמכים משנת 1984 אינם תומכים, בודאי לא באופן ברור, בטענתה לגבי כוונותיה דאז, ונזכור כי ירדן היתה לעת ההיא עדיין מדינת אויב, וכוונת הגירה אליה חייבה ויתור על אזרחות.

בנסיבות, איננו רואים מקום להתערבות בהחלטת המשיבים, ואיננו נעתרים אפוא לעתירה.

אין צו להוצאות.
