עניינה של העתירה שבפנינו בבקשת העותר, כי נורה למשיבה לייצגו, באמצעות הסניגוריה הציבורית, בבקשה למשפט חוזר אותה הוא מתעתד להגיש.
העותר הינו אסיר אשר הורשע בדין וצפוי להשתחרר מבית הסוהר בשנת 2010. כפי שעולה מן העתירה, העותר הגיש לבית המשפט המחוזי מרכז בקשה לקבלת כל החומר בתיק פ"ח 558/91 בו הורשע (עע"א 1771/06) אך זו נדחתה לטענתו, משום שהבקשה לא עסקה בתנאי מאסרו בבית הסוהר ועל כן אינה באה בגדר בקשות אסיר הנמצאות תחת סמכותו של בית המשפט המחוזי לפי סעיף 62א(א) לפקודת בתי הסוהר [נוסח חדש], התשל"ב-1971. לאחר מכן, העותר פנה לסניגוריה הציבורית לייצגו בהליך של משפט חוזר בתיק פ"ח 558/09 משום שלגרסתו יש בידיו ראיות חדשות אשר יביאו לזיכויו. ביום 27.12.2006 נפגש עם נציגי הסניגוריה הציבורית, ולטענתו, נאמר לו לפנות לבית משפט זה על מנת שימנה לו סנגור הממומן על ידי הסניגוריה הציבורית. לדידו, לפי סעיף 18(א)(9) לחוק הסניגוריה הציבורית, התשנ"ו-1995 (להלן: חוק הסניגוריה הציבורית), יש למנות סניגור ציבורי לנידון המבקש משפט חוזר.
מנגד, המשיבה, באמצעות הסניגוריה הציבורית, גורסת כי דין העתירה להידחות על הסף, מאחר ואין היא מגלה עילה להתערבות בית משפט זה. עוד טוענת היא כי העתירה נגועה בחוסר ניקיון כפיים מצד העותר, היות ומידע הנוגע לעצם העניין לא הובא בפני בית המשפט במסגרתה. לפי הנטען בתגובתה לעתירה, העותר פנה לסניגוריה הציבורית בבקשה לייצוג בהליך של בקשה למשפט חוזר ביום 11.12.2006. ביום 27.12.2006, שלחה זו מכתב ראשוני אל העותר המאשר את קבלת פנייתו. במכתב זה התבקש לפרט, עד כמה שניתן, מהן הראיות החדשות המצויות בידו ולהעביר כל חומר רלוונטי לעניין לידי הסניגוריה הציבורית לצורך בחינתו על ידה. לגרסת המשיבה, בתגובה למכתב השיב העותר כי אין בידו חומר רלוונטי להעביר לידי הסניגוריה הציבורית, ושטח את טענותיו באשר לראיות החדשות אשר יסייעו בידו בבקשתו למשפט חוזר.
המשיבה ממשיכה וגורסת כי עו"ד אפרת פינק, הממונה על מחלקת המשפטים החוזרים בסניגוריה הציבורית, ערכה חוות דעת בעניינו של העותר לאחר בדיקה יסודית של כל המסמכים בתיקו ואף שוחחה בעניין עם עורך דינו בהליכים דאז. לאחר מכן נפגשה עם העותר ביום 2.8.2007 על מנת שיוכל לשטוח את טענותיו ולהשיב על שאלות שעלו במהלך עריכת חוות הדעת. לאחר כל זאת, התקיימה פגישה אצל עו"ד ענבל רובינשטיין, הסניגורית הציבורית הארצית, בה הוחלט כי אין להיענות לבקשתו של העותר לייצוג. הודעה כאמור הועברה אליו במכתב ביום 11.10.2007, אשר לדברי המשיבה לא צורף לתגובתה, משום שיש בו מידע החוסה תחת החיסיון בין עורך דין ללקוחו. המשיבה ממשיכה וטוענת כי העותר פנה בשנית לסניגוריה הציבורית ביום 18.6.2008 על מנת שעניינו ייבחן מחדש. לאחר בדיקה נוספת, לא מצאה הסניגוריה הציבורית מקום לסטות מהחלטתה הקודמת. עוד טוענת המשיבה כי ביום 29.1.2009 פנה העותר לסניגוריה הציבורית וטען כי לא קיבל לידיו את המכתב שנשלח אליו מיום 11.10.2007, ולפיכך נשלח אליו העתק המכתב בשנית בו ביום. בתגובת המשיבה אף מצוין כי עו"ד רעות קורוליק מהסניגוריה הציבורית שוחחה עם העותר בטלפון ביום 1.2.2009 והסבירה לו שוב את הסיבות לדחיית פנייתו תו שהבהירה כי אם יהיו בידיו ראיות חדשות בעניין הרשעתו, יוכל לחזור ולפנות אל הסניגוריה הציבורית כדי שזו תשקול בחינה מחודשת של עניינו.
לאור סקירה זו, המשיבה טוענת כי העתירה אינה מגלה כל עילה להתערבות, שכן לא הצביעה על פגם כלשהו בהחלטות אשר קיבלה הסניגוריה הציבורית. זאת ועוד, מהסקירה לעיל למדה המשיבה כי העותר הציג לבית משפט זה מצג שווא, וחוטא בחוסר ניקיון כפיים, כיוון שנציגי הסניגוריה הציבורית לא אמרו לעותר כי יש מקום להגשת בקשה למשפט חוזר או עודדו אותו לפנות לבית משפט זה בבקשה למינוי סניגור ציבורי.
לאחר עיון בעתירה ובתגובת המשיבה, מצאנו כי דין העתירה להידחות על הסף. סעיף 18 לחוק הסניגוריה הציבורית מורה כי נידון המגיש בקשה למשפט חוזר יהיה זכאי לייצוג על ידי הסניגוריה הציבורית, בהתקיים תנאים מסוימים, ולאחר שהסניגור הציבורי הארצי "קבע שיש מקום להגיש בעבורו בקשה למשפט חוזר". יוצא אפוא, שלא כל אסיר המגיש בקשה למשפט חוזר זכאי לייצוג על ידי הסניגוריה הציבורית, אלא שהחלטה זו נתונה לשיקול דעתו של הסניגור הציבורי הארצי. במקרה שלפנינו, לא הצביע העותר על כל פגם בהליך קבלת ההחלטות של הסניגוריה הציבורית, עת שהחליטה לדחות את בקשתו לייצוג. משכך, ומבלי להתייחס לטענות המשיבה בדבר חוסר ניקיון כפיים של העותר, אין העתירה מגלה עילה להתערבות בהחלטת הסניגוריה הציבורית.
אשר על כן, דין העתירה להידחות על הסף.
