1.העותר, העומד לדין בבית המשפט המחוזי בנצרת בעבירות של סיוע לאויב במלחמה וקשירת קשר לסיוע לאויב במלחמה, עתר לביטול כתב האישום שהוגש נגדו בטענה כי חלק מחומר החקירה הרלבנטי לעניינו לא הועבר לעיונו משום שבוער על ידי רשויות החקירה. העותר טען בפני בית המשפט המחוזי כי החומר החסר חיוני להגנתו וכי משלא ניתן להעבירו לידיו יש לבטל את כתב האישום מטעמים של "הגנה מן הצדק". עוד טען העותר כי יש לבטל את כתב האישום נוכח ההפליה בה נהגה המדינה בכך שלא העמידה לדין אחר שהיה מעורב אף הוא באותה פרשה. המדינה הודתה כי אכן חומר חקירה בעניינם של מספר נאשמים אחרים אשר הועמדו לדין והורשעו הכולל, בין היתר, אמירות מפלילות נגד העותר בוער נוכח הזמן הרב שחלף מאז הסתיים משפטם אך טענה כי מבחינת העותר אין מדובר בחומר "מרכזי" וכי מכל מקום המקרה אינו מצדיק את ביטול כתב האישום. עוד טענה המדינה כי החלטתה שלא להגיש כתב אישום נגד אחר שהיה מעורב באותה פרשה נתקבלה משיקולים ענייניים ואין מדובר ב"אכיפה בררנית" כטענת העותר. בהחלטתו מיום 22.2.2009 דחה בית המשפט המחוזי בנצרת (סגן הנשיא השופט י' כהן, השופט א' אברהם והשופט י' אברהם) את בקשת העותר בהדגישו כי השימוש בהגנה מן הצדק שמור למקרים נדירים בהם ישנה התעמרות שערורייתית, פגיעה חמורה ועיוות דין כלפי נאשם. המקרה שבפנינו, כך קבע בית המשפט, אינו נמנה עם אותם מקרים ומשכך אינו מצדיק את ביטול כתב האישום. משנדחתה בקשתו של העותר התקיימה באותו היום, 22.2.2009, ישיבת ההקראה והעותר השיב לכתב האישום. המשך הדיון בעניינו נקבע להיום, 23.2.2009, ולימים 2.3.2009 ו-9.3.2009.
2.בעתירתו מבקש העותר להביא לביטולה של החלטת בית המשפט המחוזי ולהורות על ביטול כתב האישום נגדו בשל הגנה מן הצדק. העותר מודע להלכה לפיה אין לעקוף בדרך של הגשת עתירה לבית משפט זה את הכלל הקובע כי החלטות ביניים בהליך פלילי אינן נתונות לערעור, אך הוא טוען כי נוכח הפגיעה החמורה בזכותו למשפט הוגן המקרה דנן בא בגדר המקרים החריגים המצדיקים את התערבותנו. עם העתירה הגיש העותר גם בקשה לצו ביניים בה עתר לעיכוב הדיונים שנקבעו בתיק המתנהל נגדו בבית המשפט המחוזי כאמור, וזאת עד להכרעה בעתירה.
3.דין העתירה להידחות על הסף.
כפי שציין העותר בצדק, הלכה היא מלפנינו כי לא ניתן לעקוף את הכלל לפיו אין ערעור על החלטת ביניים בהליך פלילי, בדרך של הגשת עתירה לבית המשפט הגבוה לצדק והתערבותו של בית משפט זה בהחלטות הניתנות תוך כדי התנהלות ההליך הפלילי נעשית במשורה ומצטמצמת למקרים יוצאי דופן בהם מתעוררת טענה של היעדר סמכות או מתגלה תופעה קיצונית של שרירות בתחום שהוא מינהלי טהור (בג"ץ 10149/06 ר.ס. עובדות בע"מ נ' בית משפט השלום בבאר שבע (מיום 10.12.2006)). המקרה שבפנינו אינו נמנה עם אותם מקרים נדירים המצדיקים את התערבותו של בית משפט זה ומשכך המקום המתאים להשיג כנגד החלטת בית המשפט המחוזי הדוחה את טענת העותר להגנה מן הצדק, הוא במסגרת הערעור שיגיש על פסק הדין, ככל שהדבר יידרש (ראו בג"ץ 7934/07 אבו יוסף נ' מדינת ישראל - רשות מס הכנסה (לא פורסם, 19.9.2007)).
אשר על כן העתירה נדחית, וממילא מתייתרת הבקשה לצו ביניים.
